Velez, Esq, CPPB Interim Procurement Director Yusbel Gonzalez, CPPB enior Procurement Specialist February 11, 2014 DATE : FILE : SUBJECT: Upgrades and Maintenance for the Morphotrak Latent Workstations and Verification Workstations (Sole Source No. 13-14-008) REFERENCES: ENCLOSURES: have conducted an investigation to determine whether MorphoTrak, Inc., a Non -Local vendor, located at 1250 N. Tustin Ave., Anaheim, CA 92807, is the sole -source provider for the purchase of upgrades and maintenance for the Morphotrak Latent Workstations and Verification Workstations for the Miami Police Department. The Miami Police Department is in need of upgrading the existing MorphoTrak Latent Workstations and Verification Workstations. These workstations communicate with the Miami Dade Police Department (MDPD) Automated Fingerprint Identification System ("AFIS") and in turn the Florida Department of Law Enforcement (FDLE) and Federal Bureau of Investigation (FBI) fingerprint and criminal databases. Due to upgrades made to the MDPD AFIS, the Miami Police Department is now required to update its existing workstations so that it may continue to communicate with MDPD's fingerprint database. MorphoTrak's letter dated February 10, 2014 indicates in paragraph four (4): "MorphoTrak does not have other sales channels, partners or resellers. The proposed solution can only be procured and implemented directly from MorphoTrak." This has been verified by performing research on the internet. Government agencies such as the Department of Commerce and the Florida Department of Management Services have indicated, for their respective purchases, that MorphoTrak has no authorized resellers. Furthermore, in the past, by means of Resolutions 96-627, 06-0145; 08-0110; 09-0166; 12-0184, the City Commission has ratified, approved, and confirmed the City Manager's finding of a sole source and has waived the requirements for competitive sealed bidding procedures for the purchase, support, and maintenance of the Miami Police Department's MorphoTrak systems. Given the above findings, issuing a competitive solicitation (Invitation for Bid or Request for Proposals) for the provision of these upgrades and maintenance wouldn't be practical for the City. In accordance with Section 18-92(a)(1) of the City of Miami Procurement Ordinance, sole source awards may be made "Where the compatibility of equipment, accessories, or replacement parts permits one reasonable source of supply." Accordingly, pursuant to Section 18-92 of the Code of the City of Miami, I am recommending that the requirements for competitive sealed bidding be waived, and these findings be approved: MorphoTrak, Inc., a Non -Local vendor, located at 1250 N. Tustin Ave., Anaheim, CA 92807, is the sole -source provider for the purchase of upgrades and maintenance for the Morphotrak Latent Workstations and Verification Workstations for the Department of Police. The terms and conditions of the award have been negotiated so as to obtain the most favorable terms and conditions, including price, as may be offered to other customers or clients by MorphoTrak, Inc. The total costs for the upgrades to the latent and verification workstations, including one (1) year of warranty, shall not exceed to $92,000.00. Funds are allocated for this purchase from Police 1 Budget Operation Account No. 00001.191001.664000. The total cost for support and maintenance for both workstations shall not to cee• .29,590 ($14,576 for Year 2 and $15,014 for Year 3), subject to the availability of funds a budg -tary approval at the time of need.
