Analyses, Maps & PZAB Reso-City of Miami Planning and Zoning Department Land Development Section File ID#:13-01046sc ANALYSIS FOR STREET CLOSURE Request: Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has reviewed the proposed public right-of-way vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right-of-way, Project: Closing, vacating, abandoning and discontinuing for public use a street Location: APPROXIMATELY LOCATED ALONG THE WEST SIDE OF BISCAYNE BOULEVARD TO APPROXIMATELY 211 FEET TO THE WEST, AND ALONG THE NORTH SIDE OF NE 60TH STREET TO APPROXIMATELY 103 FEET TO THE NORTH, AND ALSO BETWEEN NORTHEAST 5TH COURT, NORTHEAST 60TH STREET AND BISCAYNE BOULEVARD, MIAMI FLORIDA. Net District: Upper East Side NET Folio #: N/A Square footage: N/A Current Zoning Designation: N/A FINDINGS AND COMMENTS: 1. The street provides access to adjacent property only and is not part of the neighborhood circulation network. 2. The streets are utilized by parents of students attending the Cushman School and vehicles serving the school. Emergency vehicles serve the school from these streets. Since the streets "loop" from Biscayne Boulevard and do not interconnect to the neighborhood street network, pedestrian and vehicular use is limited. 3. An emergency vehicle access easement will be provided on the former streets to serve the adjacent school property. A vehicular turn -around easement will be provided at the end of NE 5'h Court to properly serve properties located south of the school site. 4. The streets are not part of the neighborhood pedestrian and vehicular circulation network. Biscayne Boulevard has been recently improved with enhanced sidewalks to better facilitate pedestrian circulation. The elimination of an access connection to Biscayne Boulevard will reduce conflicts and improve traffic flow on Biscayne Boulevard. 5. The Plat and Street Committee members voted 4 in favor and 0 in denial of this street closure request subject to a public access easement for 84' diameter cul-de-sac at the closed end of NE 5ih Court and an emergency vehicle access easement on the former NE 5th Court/NE 60th Street right of way. Based on the above findings, the Planning and Zoning Department recommends Approval of the request. 10/03/2013 K. Please be advised that the processing of your tentative Plat cannot proceed until These conditions have been satisfied: 1. In the location sketch: a) Move the proposed plat name, THE CUSHMAN SCIIOOL, outside the plat area and use an arrow pointing to the site, b) Delete all proposed plat information, Only show the existing underlying legal description and the zoning information, c) Heavy up the proposed plat limits. d) Provide the block designation, Block E, for the lots 1 through 7 of PB 9-60. e) Show the line between the Not Subdivided area and P13 44-7. Also, show the lot number(s). t) Provide the name, WHITE'S SUBDIVISION OF LEMON CITY, for plats B-32 and 13-33, g) Label the City of Miami Property as EATON PARK, and indicate that the area is Not S ubdivided, li) Provide the plat name BAY SHORE for PB-60. i) Show lots 15, 16, and 17 of PB-44-7. 2, Provide the total right-of-way width for all adjacent streets. 3, In the main sketch, show existing subdivisions adjacent to the proposed plat area, including lot and block designations, subdivision names and plat book and page numbers. Also, provide the total width, 4. Provide a distance and a bearing for the centerline and monument line of each adjacent street. 5. Show the proposed 25-foot corner radius, with curve data at the NW and NE corners of the proposed plat. Also identify the external areas as to be dedicated for right-of-way by this plat and provide the square footage area. If an existing building and/or structure is to remain, a request for the waiver of the 25-foot corner radius' design standard, for said corner (s), must be submitted to the Supervisor of Plats. This also applies to the area North of NE 60 Street. 6. Label the area between the existing property line and the City of Miami base building line, as being dedicated for right-of-way by this plat and provide the square footage ttrca. 7. The tentative plat must show proposed lots and/or tracts. All boundary line distances, bearings, and curve data must be shown. This also applies to the existing lots, if they are to remain, S. Verify if the existing buildings are to remain. Provide a tie to the NE corner of Lot 4, Block E, PB 9-60. 10. Provide a statement on the tentative plat as to the proposed site development intent, 11. Existing utilities in the street to be closed and vacated crust be relocated or easements provided. 12, A certified corner record will be required at the #anal plat approval. 13, An opinion of title as to the reversionary rights for the right-of-way to be closed and vacated will be required by the Planning, Zoning and Appeals Board. The opinion of title must also address whether or not there are individuals, in addition to the abutting property owners, having an interest in the streets to be closed and vacated. A copy of the opinion of title must be provided to the Public Works Department. 14. The Planning, Zoning and Appeals Board will require a sketch and legal description, with a square footage, on an 8 '''A" X 11" paper, for the proposed closure. Provide a copy to the Department of Public Works. 15. An opinion of title, in the City of Miami opinion of title form, must be provided at the time of the final plat submittal. 16. Current backup documentation will be required for all who execute the final plat. A resolution far authority to execute documents and a Certificate of Good Standing from the Secretary of State is required, if applicable. 17. Be advised that tentative plat application must be made with Miami -Dade County after receiving approval from the City of Miami Plat and Street Committee. 18. A plat approval letter from. the F.D.O.T. is required at the time of final plat submittal. 19. Verify if the proposed plat name is acceptable, There is an existing recorded plat with a very similar name. 20. Verify if the property/structures have a historical designation. 21. Provide the existing underground utility information in the right -of --way, including storm water drainage facilities. 22. Show the Miami 21 zoning designations in the location sketch. 23. Add. ". , . in accordance with Miami 21 Zoning Code, Article 5,.." to the zoning information, 24. Provide the square footage and acres of the proposed tracts or lots on the main sketch. 25. Provide a zoning verification letter that the proposed tentative plat and street closure conforms with the intent of Miami 21 Zoning Code Section 2.1.3.1 (C), (D) and (T), 26. A letter from Comcast is required to determine if any adjustments to their facilities or easements are required. 27. All encroachments across proposed tracts and/or lot lines must be removed prior to final plat submittal. 23. Be advised that an incomplete final plat package will not be accepted by the City of Miami, It is the owner's responsibility to work with his surveyor and his attorney to assure that everything is in order before submitting the final plat package. 29, Be advised that if all the requirements for scheduling the final plat for City Commission action are not in order, the final plat will not be scheduled for a City Contmission meeting. 30. A letter of concurrency from the Miami -Dade County School Board is required prior to the final plat approval (see contact sheet). 31. Remove the legal description for the proposed Tracts A, B, and C. 32. In the title block legal description use the term "replat", not re -plat, 33, The owners of lots 12 and 13, Block 3, PB 5, PG 116 must consent to the closure and vacation of NE 5 Court/ NE=60 Street. 34. A Certificate of Appropriateness is required from the City's Historic Preservation Office, Provide a copy to Public Works. 35. A zoning exception is required for tracts that exceed the maximum size atea. 36. Delete the Zoning Ordinance 11000 designations. 37. Reference the Miami 21 Zoning Code in the site data. Provide the existing underground storm water drainage information including inverts, pipe size and pipe direction. 40. Correct the P.C. on the 25' radius at the corner of NE 5 Court and Biscayne Boulevard; the P.C, is on the base building line. 41, Update the owner's information, 42. Contact. the Publio Works Survey Section for additional technical data that must be corrected or shown on the tentative plat. 43, The Plat and Street Committee has reviewed the tentative plat of The Cushman School subdivision and determined that all technical requirements contained in the Miarni City Code Subdivision Regulations have been met and has approved the tentative plat, The members of the Plat and Street Committee have further considered the request for vacation and closure of streets with reject to Miami City Code requirements and have voted 4 in favor and 0 in denial of this vacation and closure request, subject to a platted public access casement for an adjusted 84' diameter cul-de-sac at the closed end of NE 5 Court and an emergency vehicle access easement on the former NE 5 Court/ NE 60 street ri ght-of-way. In addition to the above requirements, you should be aware of the following: 1. State and local laws require the installation of various physical improvements in the public rights -of -way when property is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part. REQUIRED: The submission of an electronic copy of the tentative plat, in an Auto CAD version, to the City of Miami Public Works Department Development and Roadway Plans Section will EXPEDITE the preparation and enhance the ACCURACY of the subdivision improvement estimate letter required for final plat approval. 2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility easements may be required on the property being platted, 3. A building permit will not be issued on the property being platted until the final plat Is recorded or as authorized by City of Miami Code Section 55-10 (i), Also, the Certificate of Occupancy for any building construction will be issued only after all the required subdivision improvements have been completed. 4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the issuance of a building permit, 5. In order to mitigate problems associated with access and construction activities throughout the neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents, in writing, of the project starting and completion dates at the time of issuance of permits. The contractor/developer may coordinate the notification of residents with the local City of Miami NET Service Center. 6, Additional items must be provided to the City of Miami Department of Public Works before the final plat is submitted to the City Commission for approval. You will be notified in writing as to what these itcrns are after the amount of the bond has been determined for the necessary subdivision improvements. 7.
