A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE BID RECEIVED JUNE 20, 2013, PURSUANT TO INVITATION TO
BID ("ITB") NO. 12-13-028, FROM ABC CONSTRUCTION INC., THE NEXT
LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, AS DESCRIBED BELOW,
FOR THE HADLEY PARK YOUTH CENTER PROJECT, CAPITAL IMPROVEMENTS
PROJECT NOS. B-30588AAND B-30588AS, IN THE AMOUNT OF $6,620,794.61,
WHICH INCLUDES $6,018,904.19, FOR THE BID AMOUNT, AN ALLOWANCE OF
$104,616.00, FOR PERMIT FEES, PLUS ATEN PERCENT (10%) OWNER
CONTINGENCY AMOUNT OF $601,890.42, FOR A TOTAL NOT TO EXCEED
AWARD VALUE OF $6,620,794.61; ALLOCATING FUNDS IN THE AMOUNT OF
$6,620,794.61, FROM CAPITAL IMPROVEMENT PROJECT NOS. B-35883AAND
B-35883AS; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT, IN
SUBSTANTIALLY THE ATTACHED FORM, CONSISTING OF THE ITB
DOCUMENTS AND ATTACHMENTS, FOR SAID PURPOSE.
WHEREAS, the Capital Improvements and Transportation Program ("CIP") issued Invitation to Bid
("ITB") No. 12-13-028 for construction services for the Hadley Park Youth Center, Project Nos.
B-35883A and B-35883AS ("Project"); and
WHEREAS, seven (7) bids were received by the Office of the City Clerk on June 20, 2013; and
WHEREAS, the Bid Security List indicates that DiPompeo Construction Corporation Inc.'s.,
("DiPompeo") bid is the lowest; and
WHEREAS, CIP had determined DiPompeo to be the lowest responsive and responsible bidder;
and
WHEREAS, as the award exceeded one hundred twenty (120) calendar days beyond the bid
opening date of June 20, 2013, a bidder may withdraw its bid by delivering written notice of
withdrawal to CIP prior to award of the contract by the City Commission; and
WHEREAS, CIP staff requested that DiPompeo confirm its willingness to accept award of the
Project at its submitted bid amount and sent two letters to DiPompeo; the first dated January 10,
2014, and a second dated January 30, 2014, for this purpose; and
WHEREAS, DiPompeo failed and/or refused to provide conformation of withdrawal in response to
these letters and accordingly, their bid is deemed withdrawn; and
WHEREAS, ABC Construction, Inc., ("ABC") the next lowest Bidder, has been determined by CIP

staff to be a responsible bidder and meets the minimum requirements; and
WHEREAS, ABC has responded in writing to a letter sent by CIP staff, dated February 4, 2014,
their willingness to comply and accept the award at its submitted bid amount of $6,018,904.19; and
WHEREAS, the City Manager requests authorization to execute a contract with ABC, in the bid
amount of $6,018,904.19, which includes an allowance of $104,616.00 for permit fees, plus a ten
percent (10%) owner contingency amount of $601,890.42, for a total not to exceed award value of
$6,620,794.61; and
WHEREAS, funds in the amount of $6,620,794.61 are to be allocated from Capital Improvement
Project Nos. B-35883A and B-35883AS;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The bid received June 20, 2013, pursuant to ITB No. 12-13-028 from ABC, the next
lowest responsive and responsible bidder, for the Project, as stated herein, in the amount of
$6,620,794.61, which includes $6,018,904.19, an allowance of $104,616.00 for permit fees, plus a
ten percent (10%) owner contingency amount of $601,890.42, for a total not to exceed award value
of $6,620,794.61, is accepted, with funds in the amount of $6,620,794.61, allocated from Capital
Improvement Project Nos. B-35883A and B-35883AS.
Section 3. The City Manager is authorized {1} to execute a Contract, in substantially the attached
form, consisting of the ITB documents and attachments, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
