A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL
AGREEMENT WITH MIAMI-DADE COUNTY TRANSIT ("COUNTY"), IN
SUBSTANTIALLY THE ATTACHED FORM, FOR THE OVERTOWN GREENWAY AT
NW 11TH TERRACE PROJECT, B-30624 ("PROJECT"); FURTHER GRANTING
AND CONVEYING THE CITY OF MIAMI A NON-EXCLUSIVE PERMIT TO ENTER
AND REMAIN ON THE COUNTY'S PROPERTY FOR THE PURPOSE OF
PERFORMING THE SCOPE OF WORK, AND PROVIDING THAT THE COUNTY
MAINTAIN THE PROJECT.
WHEREAS, the City of Miami ("City") and Miami -Dade County Transit ("County") wish to provide a
bicycle/pedestrian path and sidewalk enhancements located within the municipal limits of the City and
the County; and
WHEREAS, the scope of work consists of sidewalk improvements and beautification along
Northwest 2nd Avenue, Northwest 3rd Avenue, Northwest 11th Terrace, Northwest 11th Street, Miami,
Florida and the Metrorail Corridor (collectively "Project"); and
WHEREAS, the Project also encompasses roadway reconstruction, milling and resurfacing, the
addition of benches, lighting, trash bins and landscaping, including the planting of native trees and
adding sod along the Project limits; and
WHEREAS the City will be responsible for the design, construction, management and
administration of the Project, which is partially funded by a grant from the Florida Department of
Transportation; and
WHEREAS, the attached Interlocal Agreement ("Agreement") provides that the County agrees to
maintain the Project, and will provide the City access for the completion of the scope of work subject
to the conditions of the Agreement; and
WHEREAS, said Agreement results in no fiscal impact to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized {1} to execute an Agreement with the County, in
substantially the attached form, for the Project, granting and conveying to the City a non-exclusive
permit to enter and remain on the County's property for the purpose of performing the scope of work,
and providing that the County maintain the Project.

Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
