Law Department Matter ID No. Purpose of Item: A Resolution authorizing and permitting the restriction of vehicular and pedestrian access to the "L" shaped private alley located east of Biscayne Boulevard between NE 39 Street and the Bay Point Subdivision. Background Information: The owner of the properties at 405/443/447/455 NE 39 Street desires to construct a new development on the property. An "L" shaped private alley is located within the boundaries of the property and primarily serves only the adjacent property. The owner desires to secure the entire perimeter of the property with a fence and gates including across the private alley entrances at Biscayne Boulevard and at NE 39 Street. The attached Resolution has been prepared in accordance with the regulations contained in City Code Section 54-16(h) and will authorize a fence and/or gate to prohibit access to the private alley.
