I am the owner of and I reside in the single-family residence at 3838 N. Bayshore
Drive in Magnolia Park. My property abuts the portion of the alley between NE 38th
& NE 39th Streets.
I, Lee Brian Schrager support the petition to authorize and permit the restriction of
vehicular and pedestrian access to the "L" shaped alley located east of Biscayne
Boulevard between NE 39th Street and the Bay Point subdivision that will allow the
owner of the properties at 405/443/447/455 NE 39th St to secure the property with
the following conditions:
A. The developer/owner will submit to the City of Miami drawings for the following
modifications to the current design plans:
Reduce the dimension of the approach at the entrance to the gate at the NE
39th St access point located between 447 & 455 NE 39th Street. The approach
shall not exceed 18 feet in width.
Reduce the radius of the approach to the minimum allowed by the City of
Miami to minimize the size of the curb cut.
B. The Declaration of Condo for the subject development shall clearly define the
access point to the development located between 447 & 455 NE 39th street as
restricted to an "Entrance" only for all vehicular traffic and shall not be used as an
exit/egress from the property onto NE 39th St.
C. Mechanical device(s) shall be provided and maintained which prevent vehicular
traffic from using the access point located between 447 & 455 NE 39th St. as an
exit/egress onto NE 39th St.

D. The developer/owner agrees to provide a complete restoration of the portion of
the alley located between NE 38th & NE 39th Street which continues north of NE 39th
Street into the subject development. The developer/owner shall be fully
responsible for the restoration and all associated fees including but not limited to
permitting fees. The restoration shall include removal of existing surface of the
alley and the deteriorated curbs on both sides and shall be replaced to City of Miami
standards to the extent that the developer/owner shall not be responsible for future
maintaining or replacing the alley. Pervious materials shall be used to the extent
allowed by the City of Miami to address the standing water issues of this section of
the alley between NE 38th & NE 39th streets. This alley restoration shall be provided
simultaneously with the alley improvements located between 447 & 455 NE 39th
street and the developer/owner agrees that this project must be completed prior to
the issuance of the Certificate of Occupancy for the development at 447 & 455 NE
39th St.
All references to "developer and/or "owner" in this letter for all intents and
purposes refers to the owner and it representatives of the properties at
405/443/447/455 NE 39th St. as listed in the courtesy notification letter to the
Magnolia Park Community dated 10/22/13 signed by Nzeribe Ihekwaba, Ph.D.,P.E.
The developer/owner of the property is currently listed as G & L Real Estate
Development LLC, P.O. Box 610338 North Miami, FL 33261 and their designated
representative is Mr. Francisco Tagle.
In the event that any of the above conditions should fail to be provided and/or
failure to comply with all of the above conditions listed in this letter of support shall
result in complete and indisputable revocation of this agreement. As a result of
failure to comply and/or provide the conditions of this agreement the lot holders
shown on the Second Amended Plat of Magnolia Park dated March 5th 1916 shall be
provided unrestricted access to the "use and benefit" of the original "L" shaped
alleys as described for the purpose of the City of Miami Commission Hearing item
PH4f on Januajy 23, 2014.
