Purpose of Item: A Resolution of the Miami City Commission, with attachment(s), authorizing the City Manager to execute an Agreement on Customary Use for Local Zoning Control for Murals Under the Highway Beautification Act among the City of Miami ("City"), the State of Florida, Department of Transportation ("FDOT") and the Federal Highway Administration ("FHWA") for the purposes of establishing distance requirements and providing compliance provisions for existing non -conforming murals. Director ( 'Chief City Manager Page 1 of 2 Background Information: The Agreement on Customary Use for Local Zoning Control for Murals Under the Highway Beautification Act was negotiated with the Federal Highway Administration and the State of Florida Department of Transportation in an effort to formalize the City of Miami's ("City") request for Certification for Local Control under the framework of the Highway Beautification Act. This Agreement grants effective control to the City as it relates to the murals within the City's jurisdictional limits as defined in Chapter 62/Article 8/ Division 5 of the City Code. Under the teluis negotiated, the City will manage and enforce the relevant provisions of the code. Page 2 of 2
