HomeMy WebLinkAboutO-13426City of Miami Legislation Ordinance: 13426 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-01146 Final Action Date: 1/9/2014 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 14, ARTICLE II OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "DOWNTOWN DISTRICT", MORE PARTICULARLY BY CREATING A NEW DIVISION 3 ENTITLED "DOWNTOWN PEDESTRIAN PRIORITY ZONE", CONTAINING SECTIONS ESTABLISHING THE DOWNTOWN PEDESTRIAN PRIORITY ZONE, SETTING BOUNDARIES, ESTABLISHING STANDARDS FOR PEDESTRIAN COMFORT AND SAFETY, AND PROVIDING THAT THIS DIVISION SHALL GOVERN IN THE EVENT OF CONFLICTS; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Comprehensive Neighborhood Plan promotes a strong urban core served by mass transit and characterized by high -density mixed -use development and a pedestrian -friendly environment, and WHEREAS, Chapter 14 of the Code of the City of Miami, Florida, as amended ("City Code"), establishes a Downtown District in Miami, Florida, within which the Downtown Development Authority is empowered to study, plan, and implement initiatives to aid the economic growth of the downtown Miami area; and WHEREAS, the 2025 Downtown Miami Master Plan calls for rebalancing roadways toward transit, pedestrians and cyclists and enhancing the safety and walkability of downtown streets, including Biscayne Boulevard and Brickell Avenue, Miami, Florida; and WHEREAS, the Miami -Dade County Metropolitan Planning Organization's Downtown Miami Bicycle -Pedestrian Mobility Plan recommends the establishment of a Modal Priority Zone to safeguard the exceptional urban context of downtown Miami; and WHEREAS, the City Commission finds that establishment of a Downtown Pedestrian Priority Zone within which enhanced pedestrian comfort and safety standards for the design of all public rights -of -way will promote the safety, health, amenity, economic vitality and general welfare of downtown Miami; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in the Section. Section 2. Chapter 14/ Article II of the City Code entitled "Downtown Development/Downtown District", is further amended in the following particulars:{1} "CHAPTER 14 City of Miami Page 1 of 3 File Id: 13-01146 (Version: 1) Printed On: 12/15/2017 File Number: 13-01146 Enactment Number: 13426 DOWNTOWN DEVELOPMENT ARTICLE II. DOWNTOWN DISTRICT Division 3. Downtown Pedestrian Priority Zone. Sec. 14-63. Established; boundaries. There is hereby created a Downtown Pedestrian Priority Zone (DPPZ), the boundaries of which shall be concurrent with the boundaries of the Downtown Development Authority as described in Section 14-27 of this Code. Sec. 14-64. Standards. DPPZ standards for pedestrian comfort and safety are hereby established to account for the exceptional urban context of downtown Miami, to safeguard its unique relationship between land use and multi -modal transportation infrastructure, and to promote safety, health, amenity, economic vitality and general welfare within the DPPZ. All public rights -of -way within the DPPZ shall: (a) provide a minimum six-foot unobstructed pedestrian path at all sidewalks, (b) provide perpendicular curb ramps at all intersections, (c) provide marked crosswalks at all intersections at all four corners and mid -block crosswalks at blocks greater than 400 feet, (d) provide pre -timed fixed signals at all traffic controlled intersections with a minimum of one second of crossing time for every 2.8 feet of street width. (e) provide driving lane widths of no more than 10 feet, turning lanes of no more than 12 feet, and sharrow lanes of no more than 12 feet, fl provide sidewalk bulb -outs extending at least 20 feet from crosswalks in either direction at all street intersections and curb radii not exceeding 15 feet, (g) provide broad spectrum (white) mid -block street lighting that ensures a consistent and uniform distribution of illumination on all sidewalks, (h) provide continuous shade tree canopy on all sidewalks with widths 10 feet or greater; where sidewalks are less than 10 feet wide, require adjacent buildings to have canopies, overhangs and/or other architectural devices that provide shade onto the sidewalk area, be designed to and posted at a maximum speed limit of 25 miles per hour, and prohibit "right turn on red" at all intersections. Sec. 14-65. Conflicts with other chapters and regulations. Within the DPPZ, this division shall govern in the event of conflicts with: (a) other provisions of this Code, (b) the City's engineering standards as defined in Sec. 54-1 of this Code, (c) to the extent allowed by law, the minimum standards for public works construction as promulgated in the Miami -Dade County Public Works Manual pursuant to Section 2-100 of the City of Miami Page 2 of 3 File Id: 13-01146 (Version: 1) Printed On: 12/15/2017 File Number: 13-01146 Enactment Number: 13426 Miami -Dade County Code of Ordinances. Variances may be requested from the Miami -Dade County Public Works Director. (d) the Florida Greenbook, and (e) to the extent allowed by law, any other guidelines or standards of any other entity having jurisdiction over public rights -of -way within the DPPZ. Section 3. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} Words/and or figures stricken through shall be deleted. Asterisks indicate omitted and unchanged material. {2} If the Mayor does not sign this Ordinance, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
