Purpose of item:'
To request a 4/5th affirmative vote to waive competitive bidding procedures, as provided in Section
18-85 of the Code of the City of Miami, Florida, as amended (City Code) and ratifying the City
Manager's execution of the Professional Services Agreement with Cherokee Enterprises for the
completion of the cleanup of the property located at 1199 NW 62 Street. The cost to fully complete
the cleanup of the site is $142,857.14 in which the State of Florida Department of Environmental
Protection (FDEP), Preapproved Advance Cleanup Program (PAC) will contribute 65% and the City
will contribute 35% of the project cost which was previously allocated from Community
Development Block Grant close-out funds in an amount of $50,000 via Resolution R-13-0001.

Background Information:
The City of Miami, through the Model City Community Revitalization District Trust (Trust), entered
into an agreement with FDEP to complete the environmental cleanup of the property at 1199 NW 62
Street. FDEP contributes 65% of the project cost and the City, as the site owner, contributes 35% of
the costs. As per the agreement, payments are made directly to the contractor by FDEP as cleanup
tasks are completed. For this project, the Trust completed a solicitation for a service provider to
complete the site cleanup in compliance with applicable federal, state and local requirements and
selected CEI for this site work.
The cleanup of the property took place in accordance to FDEP program which include a year
monitoring to ensure the site is completely clean. However, this monitoring revealed that further
cleanup was required to complete the site remediation. In the interest of maintaining continuity of
work and to avoid undue additional costs and delays, it was determined to be in the City's best interest
to allow CEI to complete the additional cleanup services. Therefore, a 4/5`h affirmative vote to waive
competitive bidding procedures is required as well as the ratification of the City Manager's execution
of the contract with CEI for the City's $50,000 match.
