Authorizing an Agreement
with Cherokee Enterprises, Inc.
City of Miami Commission Meeting
of January 9, 2014
The Office of Grants Administration respectfully requests you approval and action of the
City of Miami Commission by a 4/5th affirmative vote, after an advertized public hearing
ratifying, approving and confirming the City Manager's recommendation, and finding that
competitive negotiation methods are not practicable or advantageous regarding the
agreement for the completion of the environmental cleanup for the site at 1199 NW 62
Street.
The Department respectfully requests such recommendation, finding, and authorization in
order to proceed with executing an agreement with Cherokee Enterprises, Inc. ("CEI") to
award funds, in the amount of $50,000.00 to complete the site cleanup. The State of
Florida Department of Environmental Protection ("FDEP") Preapproved Advanced
Cleanup Program ("PAC") is contributing 65% of the cost with the City of Miami
matching 35% of the project costs.
During the previous years, Cherokee Enterprises, Inc. has demonstrated its qualifications
and capacity to serve the city through the following:
1. CEI was selected through a competitive process to complete the initial
remediation project for this site.
2. CEI has experience and familiarity working at the site through its initial 2009 and
2012 cleanup efforts.
3. This company is familiar with the FDEP-PAC program requirements and is
approved by the State to complete the rehabilitation of this site.
For the reasons stated above, as required by the Section 18-85(A) of the Code of the City
of Miami, the Office of Grants Administration (1) recommends the execution of an
agreement with Cherokee Enterprises, Inc. which is qualified and has been providing said
services described above for many years, and (2) finds that the competitive negotiated
methods are not practicable or advantageous for the provision of the aforementioned
remediation services. If these recommendations and findings meet with your approval,
please indicate by signing below. The Legislation item will be placed on the agenda for
the January 9th, 2014 City Commission Meeting.
