HomeMy WebLinkAboutPre-Legislation FR/SRJ-00-671 7/27/00 ORDINANCE NO. 11946 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE BUILDING LINES/NONSTANDARD STREET WIDTHS", TO MODIFY THE WIDTH OF CERTAIN STREETS AND AVENUES IN THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY, MIAMI, FLORIDA; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS; Article V of Chapter 54 of the Miami City Code establishes base building line locations for all public streets within the City of Miami; and WHEREAS, the City Commission approved the Design Standards and Guidelines for the Southeast Overtown/Park West Redevelopment Project on March 21, 1985, which requires numerous modifications to the base building line location within the project area; and WHEREAS, the City Commission adopted Ordinance No. 10031 on September 12, 1985,. which increased the zoned width ,of certain streets in the Southeast Overtown/Park West Project area in order to accommodate future vehicular and pedestrian traffic anticipated by the redevelopment project; and WHEREAS, since the adoption of the redevelopment project, conditions in the Park West area have not materialized to allow ,the intensity of residential development that was anticipated and 11946 such traffic demand through the Southeast Overtown/Park West community will not be as high or distributed as previously stated in the redevelopment plan; and WHEREAS, the type of development now anticipated in the Southeast Overtown/Park West area varies significantly from the original redevelopment plan and includes major technology and job creation projects; and . WHEREAS, the increased .zoned street width of the roadways surrounding these projects negatively impact the building sites of the new proposed development; and WHEREAS, in order to meet the building requirements for the Network' Access Point (NAP) center, the existing property dimensions must be fully utilized; and WHEREAS, the City Administration's review of these transportation corridors reveal that the original 50 and 70 foot wide developed roadways will adequately serve the present and future transportation needs of the public; and WHEREAS, the Police, Fire -Rescue and Solid Waste Departments have evaluated the effects of the reduction of the. zoned street width of these certain roadways in the Southeast Overtown/Park West community on their operations and have no substantial objections; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference 11946 Page 2 of 5 thereto and incorporated herein as 'if fully set forth in this Section. Section 2. Chapter 54/Article V/Section 54-190 of the Code of the City of Miami, Florida, as amended, entitled "Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths" is hereby amended in the following particulars:1/ "CHAPTER 54 STREETS AND SIDEWALKS * ARTICLE V.BASE BUILDING LINES * Sec. 54-190. Nonstandard street widths. Base building lines shall be located from the centerline as. specified .for each of the following streets: Streets, Avenues, Roads Etc. in Alphabetical Order (24) 8th Street, N.E. and N.W., Biscayne Boulevard to N.E. 1st Avenue And North Miami Avenue to N.W3rd Avenue Distance in Peet from Centerline to Base . All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of a commitment by the City of Miami to an accelerated construction schedule for the Network Access Point center that will meet the requirements and needs of interrelated communication providers that serve the general public. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Gimenez City Manager� The Honorable Mayor and Members of the City Commission DATE: SUBJECT: REFERENCES: ENCLOSURES: FILE : Emergency Amendment to City Code Amending Code Section 54-190 RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance amending Chapter 54 of the Code of the City of Miami, Florida, entitled "Streets and Sidewalks" by amending Section 54-190 entitled "Nonstandard Street Widths". BACKGROUND: On March 21, 1985, the City Commission approved the Design Standards and Guidelines for the Southeast Overtown/Park West Redevelopment Project. This project requires numerous modifications to the base building line location within the project area. The City Commission adopted Ordinance No. 10031 on September 12, 1985, which increased the zoned width of certain streets within the project area in order to accommodate future .vehicular and pedestrian traffic anticipated by new development. Since the adoption of the redevelopment project, conditions in the Southeast Overtown/Park West area have not materialized to allow the intensity of residential development that was anticipated and traffic demand through the Southeast overtown/Park West will not be as high or distributed as previously stated in the redevelopment plan. The type of development now anticipated varies significantly from the original redevelopment plan and includes major technology and job creation projects, most notably the proposed Network Access Point (NAP) Center. In order to meet the building requirements for the NAP project, the existing property dimensions must be fully utilized. The increased zoned width of the roadways surrounding the NAP project, including. NE 8 Street, NE 9 Street, North Miami Avenue and NE 1 Avenue, negatively impact the building site and the proposed structure. These roadways were originally zoned a narrower width than what was anticipated in the Southeast overtown/Park West redevelopment plan and were developed with pavement, curb and gutter and sidewalk conforming to the narrower width. None of the additional reserved private property has been dedicated for street purposes to the widths contained in the Southeast overtown/Park West redevelopment plan. The Public Works Department's review of this transportation corridor reveals that the developed roadways within the original zoned street widths adequately serve the transportation needs of the public. The Police, Fire -Rescue and Solid Waste Departments have been notified of the proposed reduction of the zoned width of these roadways. Odio City Manager ONT E: JAM 2 1986 SURJECT: REFERENCES: F1LE: AMENDMENT TO CITY CODE First Reading of Ordinance Amending Code Section 54-104 ENCLOSURES: (For Commission Meeting of January 9, 1986) It is recommended that an ordinance be adopted amending Chapter 54 of the Code of the City of Miami entitled "Streets and Sidewalks" by amending Section 54-104 entitled "Nonstandard Street widths". Article V of Chapter 54 of the Miami City Code establishes the width of all public streets within the City by establishing base building line locations. The Department is proposing to change the base building line locations for several streets by adding or deleting those streets from Section 54-104 entitled "Nonstandard Street Widths". The reasoning for the proposed amendment is as follows: N.W. 28 Street between N. Miami Avenue and N.W. 2 Avenue is being reduced in width from 70 feet to 50 feet. At the present time, N.W. 28 Street is 50 feet wide and the other residential streets in the immediate neighborhood are also 50 feet wide. The City intends to rebuild this portion of 28 Street to its current 50 foot width in Wyndwood Highway Improvement 8-4514 in 1986. N.W. 2 Avenue between N.W. 17 Street and N.W. 20 Street now has a dedicated width varying from 9.4 feet at 20 Street to 14.2 feet at 17 Street, but is zoned for an ultimate width of 50 feet. This 50 foot width is being reduced to 30 feet. This reduction has been requested by Metropolitan Dade County H.U.D. The County intends to construct housing units on County owned property on N.W. 2 - Avenue between 19 and 20 Streets and believes that the developability of the site would be enhanced by the change in street width. X d O 7 7- Greenwood Drive between S.W. 27 Avenue and its westerly terminus is being reduced from 50 feet to its original platted width of 30 feet. This is a dead-end street, approximately 80 feet in length, and does not warrant a zoned width of 50 feet. Miami Avenue between N.W. 5 Street and N.W. 14 Street is being increased in width from 70 feet to 95 feet. This revision was recommended in the Design Standards and Guidelines for the Southeast Overtown/Parkwest Redevelopment Project already approved by the City Commission in 1985.
