HomeMy WebLinkAboutO-13420City of Miami Legislation Ordinance: 13420 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-01235 Final Action Date: 12/12/2013 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE BUILDING LINES/NONSTANDARD STREET WIDTHS", BY MODIFYING THE WIDTH OF NORTH MIAMI AVENUE FROM NORTH 5TH STREET TO NORTH 8TH STREET AND FROM NORTH 9TH STREET TO NORTH 11TH TERRACE, MIAMI, FLORIDA; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of Chapter 54 of the Code of the City of Miami, Florida, as amended ("City Code"), establishes base building line locations for all public streets within the City of Miami ("City"); and WHEREAS, North Miami Avenue from North 5th Street to North 11th Terrace, Miami, Florida, was originally zoned as a 70 foot wide roadway; and WHEREAS, the zoned street width of this roadway was increased to a 95 foot wide roadway pursuant to Ordinance Number 10077, adopted February 13, 1986, but has not been developed to the 95 foot width; and WHEREAS, the zoned width of the segment of North Miami Avenue between North 8th Street and North 9th Street, Miami, Florida, was previously reduced from 95 feet to 70 feet wide to accommodate the development of the Network Access Point Center pursuant to Ordinance Number 11946, adopted July 27, 2000; and WHEREAS, the Public Works Department has evaluated the pedestrian and traffic operations, utility and access needs in this area for present and potential future development and determined that a reduction in the zoned street width of North Miami Avenue from North 5th Street to North 8th Street and from North 9th Street to North 11th Terrace, Miami, Florida, from 95 feet to 70 feet will have no substantial impact on these services; and WHEREAS, the Departments of Police, Fire -Rescue and Solid Waste have evaluated the effect of the reduction of the zoned street width of this roadway on their operations and have no substantial objections; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 3 File Id: 13-01235 (Version: 1) Printed On: 9/22/2017 File Number: 13-01235 Enactment Number: 13420 Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as fully set forth in this Section. Section 2. Chapter 54/Article V/Section 54-190 of the City Code, entitled "Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths", is amended in the following particulars: {1} "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE V. BASE BUILDING LINES Sec. 54-190. Nonstandard street widths. Base building lines shall be located from the centerline as specified for each of the following streets: Streets, Avenues, Roads, Etc., In Alphabetical Order: * * * Distance in Feet from Centerline to Base Building Line (253) Reserved Miami Avenue, North, North 5th Street to North 8th Street and North 9th Street to North 11 th Terrace 47.5 (254) Miami Avenue, North, North 8 5th Street to North 9th Street and 11th Terrace to North 36th Street 35 *11 Section 3. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4.
