TWIN PROPERTIES OF MIAMI, LLC, Plaintiff, vs. CITY OF MIAMI, Defendant. COMPLAINT TO QUIET TITLE Plaintiff, Twin Properties of Miami, LLC ("Plaintiff"), by and through its undersigned counsel, hereby sues Defendant, the City of Miami ("Defendant") and hereby alleges as follows: PARTIES, VENUE, AND JURISDICTION 1. This is an action to quiet title in real property located in Miami -Dade County, Florida, pursuant to Fla. Stat. §65.061. 2. Plaintiff owns real property located in Miami -Dade County, Florida which is at issue in this dispute. 3. Defendant is a municipal corporation and subdivision under the laws of the State of Florida and is located in Miami -Dade County, Florida. 4. The Property (as defined below) at issue in this litigation is located within Miami - Dade County, Florida. Thus, venue is proper in Miami -Dade County, Florida pursuant to Fla. Stat. §47.051, and this Court has jurisdiction over the subject matter of this action pursuant to Fla. Stat. §26.012(2)(g). HABER LAW, LLP 251 NW 23RD STREET, MIAMI, FLORIDA 33127 GENERAL ALLEGATIONS 5. Plaintiff is the owner of the land located at: 5 E Flagler Street, Miami, Florida 33131 (the "Property"), which is legally described as: "The South 25 feet of Lot 10, and all of Lot 11, Block 116, North City of Miami, according to the Plat thereof, as recorded in Plat Book "B", Page 41, of the Public Records of Miami -Dade County, Florida." 6. The building at the above referenced Property was constructed in 1949. 7. Plaintiff is the owner of the Property, and obtained title by virtue of a Warranty Deed dated April23rd, 1987, and recorded at OR Book 13263, at Page 2209 in the Official Records of Miami -Dade County, Florida, on April 29, 1987, and a subsequent Quit Claim Deed dated June 5, 1987, and recorded at OR Book 13318, at Page 3505 in the Official Records of Miami -Dade County, Florida, on June 19, 1987. 8. On November 28, 2021, a Notice of Violation was issued to the Plaintiff by Defendant's Code Enforcement Inspector, Jason Mignott, related to Graffiti on the Property, in violation of City Code Sec. 37-2, and Failure to Comply with Citywide Illumination Standards, in violation of City of Miami Code Article 10 Sec. 10-143 - 10-146. 9. The City of Miami's Notice of Violation citation issued on November 28, 2021, required compliance by December 8, 2021. 10. Unfortunately, the violations were not brought into full compliance by the December 28, 2021, deadline, and on April 20, 2022, the Defendant's Code Enforcement Department issued the Plaintiff a Notice of Violation Summons to Appear before the Code Enforcement Board for a hearing on May 5, 2022. 2 HABER LAW, LLP 251 NW 23RD STREET, MIAMI, FLORIDA 33127 11. Graffiti is created by third parties and it is very difficult to prevent graffiti on buildings in Miami, Florida due to the random nature of such third party actions. The Owner did not create the graffiti so the Owner should not be penalized for same. 12. The Plaintiff was able to have the Graffiti removed from the Property and had retained electricians to review and evaluate the lighting issues but these were not cleared prior to the May 5, 2022, Code Enforcement Board's hearing date. 13. At the hearing on May 5, 2022, no party appeared on behalf of Plaintiff, and the Code Enforcement Board, having only received testimony from the Code Compliance Division, that the Property was not in full compliance, found Plaintiff guilty of violating City Code Section 37-2 and City of Miami City Code Article 10 Sec. 10-143 — 10-146, and issued a Final Administrative Enforcement Order (the "Order"). 14. The Order directed that the violation be corrected by May 6, 2022 (only one day later), or a $500.00 per day fine would thereafter be assessed. 15. On May 7, 2022, the violation having not yet been brought into full compliance, the Defendant began assessing a $500.00 per day fine against the Property. 16. On May 11, 2022, Code Enforcement Inspector, Jason Mignott, of the City's Code Enforcement Division, drafted an Affidavit of Non -Compliance. 17. On May 18, 2022, the Code Enforcement Hearing Board's May 6, 2022, Order was recorded. A true and correct copy of the Code Enforcement Hearing Board's Final Administrative Enforcement Order is attached hereto as Exhibit "A." 18. In early March of 2023, the Plaintiff did complete the necessary electrical repairs to enable the exterior lighting at the Property to function properly, and he was under the mistaken understanding that those electrical repairs brought the Property into compliance. 3 HABER LAW, LLP 251 NW 23RD STREET, MIAMI, FLORIDA 33127 19. Unfortunately, the Plaintiff mistakenly did not call for a reinspection of the Property and the fines related to this violation continued to run until July 1, 2024, when after another minor electrical repair was conducted, the Property was finally brought into full compliance. 20. On July 1, 2024, City of Miami, Code Enforcement Inspector, Jason Mignott inspected the Property and issued the Plaintiff an Affidavit of Compliance, which indicates that the Violation(s) on the cited Property pertaining to case CE2021024620 had been corrected and the Property was deemed "in compliance". A true and correct copy of the above referenced Affidavit of Compliance is attached hereto as Exhibit "B." 21. A lien, related to the City of Miami Code Enforcement Board's Final Administrative Enforcement Order, exists upon the Property. 22. Based upon the recorded lien, the City imposed daily fines on the Plaintiff in the amount of $500.00 per day starting on May 7, 2022, for a total of 786 days up to and including the date of compliance on July 1, 2024. 23. To date, the total fine imposed against the Property amounts to $393,000.00 and constitutes a lien on the Property. 24. Before filing this cause of action, Plaintiff communicated with Defendant in an attempt to mitigate the fines to no avail. 25. All conditions precedent to the filing of this action have been performed, excused or have been waived. COUNT I — QUIET TITLE 26. This is an action to quiet title pursuant to FLA. STAT. §§65.021 and 65.061. 27. Plaintiff incorporates and realleges the allegations in paragraphs 1 through 25, which are incorporated as if set forth fully herein. 4 HABER LAW, LLP 251 NW 23RD STREET, MIAMI, FLORIDA 33127 28. The City of Miami, Code Enforcement Hearing Board's Final Administrative Enforcement Order imposed a lien on the Property. 29. Defendant may claim an adverse interest in the Property by virtue of the aforementioned lien. 30. Defendant does not have a lawful or legitimate interest in the Property, and any interest in the Property, if any, is subordinate and inferior to the Plaintiff's right, title and interest in the Property. 31. Plaintiff is authorized to bring an action to quiet title to the Property and to clear any cloud on its title. See Section 65.031, Florida Statutes ("An action in chancery for quieting title to, or clearing a cloud from land, may be maintained in the name of the owner or of any prior owner who warranted the title.") 32. Plaintiff has a compelling interest in removing the cloud of title unposed by the Order and the lien because the title of the Property is currently unmarketable. WHEREFORE, the Plaintiff respectfully requests that this Court enter a judgment in its favor and against Defendant, extinguishing any right or claim that Defendant may have in the Property, and removing any and all clouds on title to the Property, and quieting title in the Plaintiff, together with any and such further relief as this Court deems necessary to protect Plaintiff's rights and interests to the Property.
