Subject: Concession Agreement ("Agreement") with Lopetegui Corporation ("Concessionaire") for the
operation of the City of Miami Police Headquarters Building cafeteria located at 400 NW 2 Avenue, Miami

Purpose of Item:
A Resolution of the City of Miami Commission, accepting the recommendations of the City Manager to
approve the findings of the evaluation committee that the top ranked firm, pursuant to Request for Proposals
("RFP") 344290 for food and beverage concessions at the city -owned property known as the City of Miami
Police Headquarters Building located at 400 NW 2 Avenue, Miami Florida, is Lopetegui Corporation; further
authorizing the City Manager to execute the attached Concession Agreement ("Agreement"), in substantially
the attached form, with Lopetegui Corporation, for the management and operation of a food and beverage
concession at the Police Department Headquarters Building for a minimum rent $500.00 per month and
percentage rent of 1% increasing annually , with terms and conditions as more specifically set forth in said
agreement.

Subject: Concession Agreement ("Agreement") with Lopetegui Corporation ("Concessionaire") for the
operation of the City of Miami Police Headquarters Building cafeteria located at 400 NW 2 Avenue, Miami
Florida
Background Information:
On May 31st, 2013, the City of Miami's ("City") Purchasing Department issued a Request for Proposals ("RFP")
soliciting proposals from qualified individuals or business entities interested in operating and managing the
cafeteria located at the City of Miami Police Headquarters building located at 400 NW 2 Avenue, Miami,
Florida. One (1) responsive proposal was received by the City on July 13, 2013. The proposer was Lopetegui
Corporation.
The City Manager appointed the members of the evaluation committee to evaluate proposals received in
response to the RFP on October 8, 2013. The evaluation committee conducted a site visit, including taste
testing, at the location being operated by the one responsive proposer and reviewed the proposal based on
specific criteria in the RFP and evaluations provided from site visits and taste testing.
The evaluation committee recommended that the City negotiate and execute a Concession Agreement with
the sole respondent, Lopetegui Corporation, for the City of Miami Police Headquarters cafeteria.
In the event the City is unable to consummate an agreement with Lopetegui Corporation for the Police
Headquarters cafeteria, the City shall reject the sole proposal received and issue a new Request for Proposals.
Highlights of the Concession Agreement for the Police Headquarters Building location are as follows:
Purpose: To provide for the management and operation of the food service concession at the Police
Headquarters cafeteria.
Term: Five (5) years.
Options: One (1) additional five (5) year term.
Monthly Use Fee: •$500.00 plus State of Florida Use Tax, if applicable
Percentage Fee: First Year One Percent (1%)
Second Year Two Percent (2%)
Third Year Four Percent (4%)
Fourth Year Five Percent (5%)
Fifth Year Seven Percent (7%)
