HomeMy WebLinkAboutCity of Sweetwater Bid DocumentsCONTRACT FOR THE SUPPLY AND INSTALLATION OF SYNTHETIC TURF PREAMBLE This Contract, is entered into on A7tet14 0 , 2013 by and between Easygrass, LLC. ("Easygrass") and the City of Sveetwater (the "City") (collectively, the "Parties"): Whereas, Pursuant to §2-229 of the City Code of Ordinances, the City of Sweetwater solicited sealed bids for the supply and installation of synthetic turf under RFP 2013-01; and, Whereas, seven entities expressed interest in the solicitation and received the bid package, either in person or by email; and, Whereas, Easygrass was the sole bidder; and, Whereas, by Resolution 3751, dated March 4, 2013 the City Commission by unanimous vote waived the City's three -bid requirement and accepted Easygrass' contract; and, Whereas, Resolution 3751 specifically authorizes the Mayor and the City Clerk to enter into a contract with Easygrass pursuant to the terms of the bid; Now therefore the Parties hereby enter into the following contract: TERMS 1. The Preamble is incorporated herein as if set forth in full. 2. Easygrass shall supply and install synthetic turf under the terms contained in its response to the bid package, which is attached hereto and made part hereof as Exhibit A and which is incorporated herein as if set forth in full. 3. This Contract is to be construed under the laws of the State of Florida. 4. In the event of litigation arising out of this Contract, venue shall exclusively lie in Miami - Dade County, Florida. 5. In the event of contractual litigation arising out of this Contract, each party knowingly, purposefully, and as a direct inducement to this Contract, hereby waives a trial by jury. 6. In the event any portion or portions of this Contract are deemed void or unenforceable, the remainder of the Contract shall continue in full force and effect nonetheless. In the event the person executing this document is an agent of a Party, said person, as a crucial and material inducement to the other Party% executing this Contract, specifically represents he has both the apparent and actual authority to act on behalf of his principal and to bind his principal to the terms of this Contract. 8. Neither party shall be liable or deemed in default for any delay or failure in performance under this Contract or other interruption of service resulting, directly or indirectly, from acts of God, civil or military authority, acts of public enemies, war, accidents, fire explosions, earthquakes, floods, hurricanes, tornadoes or any cause beyond the reasonable control of either party. 10. Keep it Clean A.Dust, pollen, and airborne pollutants Rainfall is the best cleanser. In areas where rainfall is scarce, an occasional water flush is beneficial to cleanse the turf. For lightly soiled areas, it may be necessary to sponge mop with a five (5) percent solution of low sudsing household detergent in warm water followed by a thorough rinsing with warm water. For heavily soiled areas, repeat procedure for lightly soiled areas follow with sponge mopping using a three (3) percent solution of household ammonia in warm water followed by a thorough rinsing with warm water, B. Stains and other blemishes The first rule is promptness. It is always easier to clean up a fresh spill than one that has dried and hardened. Remove any solid or paste -like deposit with a spatula or table knife. Blot up excess liquids with paper towels, a clean cloth, or a dry absorbent, such as kitty litter or fuller's earth. Dry absorbents can then be swept or vacuumed up afterwards. Synthetic fibers have high resistance to staining. However, it is important to realize they are only one part of a sophisticated system of various components designed for overall performance. Some cleaning agents safe for the face fibers can be harmful to other components of the turf system. Therefore, cleaning agents are grouped into two sets, one of which can be used in Iiberal amounts directly on the turf surface, and the secondof which should only be applied by rubbing a cloth soaked in the cleaner in order to minimize penetration of possible harruful agents below the turf surface. In the first group of cleaners which generally can be applied without any special precautions are the following: • Sirnple GreenT , a bio-friendly cleaner. Follow the manufacturer's instructions. • A warm, mild solution of granular household detergent or any low sudsing detergent for fine fabrics. Use approximately one teaspoon of detergent to one pint of water. • This will handle most waterborne stains including: • Ketchup • Butter • Alcohol • Cola • Water colors • Latex paint • Blood • Urine • Dye • Coffee • Tea • Fruit juices • Vegetable juices • Milk • Cocoa • Ice Cream • Mustard • Glue • A three (3) percent solution of ammonia in water may be used in lieu of household detergent for more stubborn stains. • Do not use cleaners that contain chlorine bleaches or caustic cleaners (ph above 9) or highly acidic cleanses (ph below 5). • Rinse area thoroughly with clean warm water to remove any traces of soap or ammonia. • Blot up excessive liquid. The second group of cleaners, where agent must be applied sparingly and care taken to avoid penetration beneath the turf are the following: • Mineral spirits or a grease spot remover like perchlorethylene (dry cleaning solution) of the type sold by most variety stores and supermarkets. In general, cleansers in this category should handle most oil. -based stains including: • Chewing gum • Shoe polish • Lipstick • Paraffin wax • Nail polish • Crayon • Asphalt and tar • Cooking oil • Floor wax • Motor oil & grease • Ballpoint ink • Suntan oil CAUTION: mineral spirits and other petroleum based solvents are flammable. Do not smoke or permit open flames near where these are being used. Be sure the area is well ventilated where solvent cleaners are used. C. Animal waste Neutralize with mixture of white distilled vinegar in an equal amount of water. Flush thoroughly with water after application. D. Chewing gum In addition to dry cleaning fluid, chewing gum can be removed by freezing. Aerosol packs of refrigerant are available from most carpet cleaning suppliers for this purpose, or dry ice can be used. After freezing, scrape with a knife. E. Fungus or mold spots A one (1) percent solution of hydrogen peroxide in water can be sponged on to the affected area. Flush thoroughly with clean water after application. F. Periodic Brushing Matting of fibers may occur in areas of high foot traffic, especially if fibers have become soiled with dirt and other airborne pollutants. Periodic "cross brushing" of the turf can help restore the aesthetic appearance of the turf. "Cross brushing" means all brushing activity takes place against the grain, nap, or sweep of the turf fibers. By brushing against the turf, the fibers are "fluffed up". A brush with synthetic bristles should be used. Never use a brush with metal or wire bristles as these will change the turf fibers. III. Do Not Abuse Although your SYNLawn brand turf is made of tough, durable fibers, certain precautions should be taken to prevent damage to the turf. Lighted cigarettes cannot ignite the turf, but they can damage the turf by fusing the tips of the fibers together. Cigarettes, fireworks, and open flames should be kept away from the turf. Furniture and equipment with sharp or jagged edges should not be placed on turf as this may puncture or tear the turf. • Never leave a parked vehicle idling on the turf. • Cap off or remove nearby sprinkler heads. Water from sprinkler systems can leave mineral deposits on turf that may cause discoloration. • Make sure turf is not exposed to reflected sunlight windows as this may fuse the turf fibers together. BACKGROUND Over the past several years, many cities have installed the latest generation of synthetic turf on their athletic fields and other open spaces, replacing natural turf. The preliminary results have been overwhelmingly positive, and many more cities have several proposals for additional synthetic turf projects. Cities have made the change because synthetic turf has several advantages over natural turf: (1) The new synthetic turf areas have significantly lowered operating costs because of reduced maintenance labor and material to maintain. Traditional irrigating, fertilizing and mowing, that are required on natural turf areas are not necessary on synthetic turf areas. (2) The new synthetic turf fields or areas increase by 40% to 60% the amount of playable hours. By also utilizing modified field layouts and multi -field overlap capacity, additional hours of play can be actualized. The synthetic turf fields do not have to be closed for long periods of maintenance and rehabilitation, and rarely have to be closed due to rainy weather. Furthermore, unlike their natural turf counterparts, they do not require the imposition of a ceiling on playable hours in order to protect the quality of the field. (3) The new synthetic turf fields have a superior quality playing surface. The flatness and uniformity of the new synthetic turf fields produce venues that provide better and safer recreational opportunities for soccer, baseball, softball and other sports. PROJECT OVERVIEW The City of Sweetwater desires to retain the services of a qualified supplier of artificial turf products for various yet to be determined areas within the City. The City may exercise its rights not to pursue such projects at its own discretion and upon lack of funding availability. The purpose of this RFP is to pre -qualify and select a vendor for such services in the event that the City decides to proceed with such services at a time of which funding is available. In addition to the selection criteria and scope specified in this document, proposals must comply with the conditions of the solicitation, provided the proposal is reasonable and it is in the interest of the City to accept it. The city has currently no allocated funds associated with this solicitation; however, the city intends to award pending possible future funding availability in an effort to save time and minimize costs. WARRANTY Neither the final payment nor any provision of the solicitation documents, nor the use of the product by the City shall constitute an acceptance of items found not to comply with stipulations of the scope of service. The Award will be awarded only to a Proposer fully qualified to undertake the proposed anticipated work. All material or services must meet all applicable Federal, State and Local specifications and regulations. PROPOSERS with an established verifiable local presence strongly preferred. SAFETY PRECAUTIONS The Proposer shall maintain suitable and sufficient guards and barriers and, at night, suitable and sufficient safety standards required by Municipal, County, State and Federal ordinances and laws to assure the safety of the residents of the City. Proposer shall submit schedule to city staff before starting work. PRE -PROPOSAL INSPECTION No pre -proposal inspection is required. Proposers are recommended to become familiar with the open spaces within the City to best determine the character of the work, any possible difficulties, and all conditions and circumstances which do and may affect the work. No specific project or area has been identified as part of this solicitation. PERFORMANCE AND PAYMENT BONDS No Bonds of any kind are required as part of this solicitation; however, the city may determine that a bond may be required based on any future work orders issued depending on the size of a project.
