HomeMy WebLinkAboutR-13-0505City of Miami Legislation Resolution: R-13-0505 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-01351 Final Action Date: 12/12/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER A NOTICED PUBLIC HEARING RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S RECOMMENDATION AND FINDINGS THAT IT IS IN THE BEST INTEREST OF THE CITY OF MIAMI ("CITY") TO WAIVE THE REQUIREMENTS FOR COMPETITIVE BIDDING PROCEDURES PURSUANT TO SECTION 18-85 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT ("AGREEMENT"), BY AND BETWEEN THE CITY AND 3700 GRAND AVENUE, LLC, C/O ANTHONY PARRISH, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE PURPOSE OF A POLICE SUBSTATION, AND SETTING FORTH A BASE RENT OF $18,000.00 AYEAR PAYABLE AT A RATE OF $1,500.00 A MONTH TO BE PAID AT THE SOLE COST AND EXPENSE BY THE SARNOFF FOUNDATION FOR THE PROPERTY LOCATED AT APPROXIMATELY 3727 GRAND AVENUE, MIAMI, FLORIDA, FOR A TERM OF TWO (2) YEARS COMMENCING ON THE EFFECTIVE DATE OF THE AGREEMENT. WHEREAS, 3700 Grand Avenue, LLC, c/o Anthony Parrish ("Landlord"), owns the property located at 3727 Grand Avenue, Miami, Florida ("Premises"); and WHEREAS, the City of Miami ("City") Police Department has an urgent need to rent this space for a police substation; and WHEREAS, the Landlord is willing to offer the Premises to the City at a yearly rental rate of $18,000.00 for increased police presence and visibility to be afforded by the City's Police Department; and WHEREAS, the rent shall be paid at the sole cost and expense by the Sarnoff Foundation; and WHEREAS, the City is desirous of renting the Premise to obtain increased police visibility and presence for the residents living in the West Grove and surrounding areas of the Premises to increase security and deter crime in this location; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after a noticed public hearing the City Manager's recommendation and findings that it is in the best interest of the City to waive the City of Miami Page 1 of 2 File Id: 13-01351 (Version: 2) Printed On: 9/22/2017 File Number: 13-01351 Enactment Number: R-13-0505 requirements for competitive bidding procedures, pursuant to Section 18-85 of the Code of the City of Miami, Florida, as amended, are ratified, approved, and confirmed. Section 3. The City Manager is authorized{1} to execute a Lease Agreement ("Agreement"), by and between the City and the Landlord, in substantially the attached form, for the purpose of a police substation and setting a base rent of $18,000.00 a year payable at a rate of $1,500.00 a month to be paid at the sole cost and expense by the Sarnoff Foundation for the Premises, for a term of two (2) years commencing on the effective date of the Agreement. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
