ANALYSIS FOR
STREET CLOSURE
Request: Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has
reviewed the proposed public right-of-way vacation and closure to determine whether it is in the
public interest, or whether the general public would benefit from the vacation of the right-of-way.
Project: Closing, vacating, abandoning and discontinuing for public use a street
Location: LOCATED BETWEEN NORTHEAST 30TH TERRACE AND NORTHEAST 31ST STREET ON
THE WEST SIDE OF BISCAYNE BAY, AND ALSO, BETWEEN NORTHEAST 31ST STREET AND 32ND
STREET ON THE WEST SIDE OF NORTHEAST 7TH AVENUE, MIAMI FLORIDA.

FINDINGS AND COMMENTS:
1. The applicant proffers a new public park located on the Bayfront that provides greater
public access and enjoyment of Biscayne Bay. The creation of new roadways upon
recording of the plat, including NE 6th Avenue between NE 31 Street and NE 32 Street,
and NE 7 Avenue between NE 30 Terrace and NE 31 Street, will result in improved
circulation throughout the neighborhood and greater public access to the Bayfront.
2. The general public, emergency and service vehicles are currently using the entire length
of NE 31 Street from Biscayne Boulevard to Biscayne Bay.
3. The proposed new roadways will improve access and circulation for the general public,
emergency and service vehicles to the proposed plat site, to the entire surrounding
neighborhood and to the proposed park.
4. The proposed new roadways will improve vehicular and pedestrian traffic circulation and
access to the entire neighborhood.
5. The Plat and Street Committee members voted 6 in favor and 0 in denial of this street
closure request subject to the following conditions:
a) The applicant shall execute a covenant to run with the land to maintain the proposed
Tract A located west of the NE 6 Avenue 50 foot wide roadway alignment.
b) The applicant shall execute an agreement to run with the land to maintain the
proposed park (Tract C).

c) A platted development restriction to comply with the requirements of the Miami 21
Zoning Code concerning the NE 31 Street view corridor.
Based on these findings, the Planning Department recommends approval of the request.

Dear Ladies and Gentlemen;
The City of Miami Plat and Street Committee, at its meeting of October 3, 2013 approved the
above tentative plat subject to the following revisions being made to the tentative plat, additional
information being provided and/or variances being granted, Please be advised that the processing of your
tentative plat cannot proceed until these conditions have been satisfied;
1, hi the location sketch:
a) Verify the location of Tract A (P.B. 161, P.G, 75) and Lot 10 (PB, 16, P,G, 70), Lot 10 is now
part of Tract A of P.13. 161, P,G.75.
b) Verify the Plat Book and Page ofMARBELLA SUBDIVISION PB 102, PG 49,
c) Show the PLATINUM TRACT P13 161, PG 74.
d) Verify the length of Lot 10, Block 9 of PB 2, PG 37, and label the remainder portion to the East
as Not Subdivided,
e) Label NE 29r'` Terrace as such.
f) Reference the plat book and page numbers, 163-41, for MOONBAY. Also, label areas East and
West of said plat as Not Subdivided.
2. The underlying plat name for N,E. 30th Terrace is Hoag Street, not Columbia Avenue,
3, Clarify if the 6-foot sanitary sewer easement is to remain or will be released. Provide copy of the
release statement,
4. Provide an opinion of title for the remnant portion of Lot 10, Block 6 of Plat Book 2 at Page 37.
5. Provide a copy of the Certified Corner Record.
6. Provide an opinion of title for the remnants portions of the property formerly identified as "alley"
located East and West of the tentative plat.
7. Existing utilities, if any, in the former alley and the portion of NE 31 Street being closed and vacated
must be relocated or easements must be created.
8. An opinion of title as to the reversionary rights for the portion of the street to be closed and vaeated
will be required by the Planning, Zoning and Appeals Board (PZAB),The opinion of title must also
address whether or not there are individuals, in addition to the abutting property owners, having an
interest in the street to be closed and vacated, A copy of the opinion of title must be provided to the
Public Works Department,
9. The Planning, Zoning and Appeals Board (PZAB) will require a sketch and legal description, with a

square footage, on an 8 ,"X 11" paper, for the proposed closure. Contact the Hearing Boards, at
(305) 416-2030. Provide a copy to the Department of Public Works.
10. The underlying plat dedicated the street to the purchasers of lots in the subdivision. Provide and
opinion of title, with reference to Section 177,085 of the Florida Statutes, to determine if any suits
were i 1ed on or before July 1, 1973,
11, Provide a zoning verification letter concerning the effect of the dedication of the right-of-way on the
zoning calculations.
12. Provide a verification letter front the Supervisor of Plats concerning the configuration of the proposal
"NE 6 Avenue".
13, Provide a verification letter from the Director of the Parks and Recreation Department concerning the
donation of a now park to the City.
14. Section 3.8,2 (c) of the Miami 21 Zoning Code establishes a maximum average length of frontage,
Provide a zoning verification letter that the proposed Tracts meet the requirements of the Miami 21
Zoning Code,
15, A platted development restriction will be required to comply with the requirements of the Miami 21
Zoning Code concerning -the NE 31 Street view corridor.
16. There are sanitary sewer and storm sewer facilities located in NE 31 Street within the section to be
closed and vacated. These facilities must be relocated and/or easements must be provided.
17. There is a sanitary sewer facility located in the North/South easement to be closed and vacated, This
sanitary sewer serves properties located outside the limits of the proposed plat. This existing facility
must be relocated and/or new easements must be provided.
18. A letter from Comcast is required to determine if any adjustments to their facilities or easements are
required.
19, Verify with the Miami -Dade County that the proposed plat name is acceptable.
20. All encroachments across proposed tracts and/or lot linos must be removed prior to final plat
submittal.
21. An Opinion of Title, in the City of Miami Opinion of Title form must be provided at the time of the
final plat submittal.
22. Current backup documentation will be required for all who execute the final plat. A resolution for
authority to executedocuments and a Certificate of Good Standing :from the Secretary of Stateare
required, if applicable,
23. Tentative plat application must be made with Miami -Dade County after receiving approval from the
City of Miarni Plat and Street Committee.
24, Show existing underground storm sewer information within the right ofway including invents, pipe
size and direction.
25, Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the
owner's responsibility to work with his surveyor and his attorney to assure that everything is in order
before submitting the final plat package.
26, Be advised that if all the requirements for scheduling the final plat for City Comnnissiona action are not
in order, the final plat will not be scheduled for a City Commission meeting.
27. A letter or concurrency from the IVliarni-Dade County School Board is required prior to the final plat
approval (see contact shoot).
28. The Plat and Street Committee has reviewed the tentative plat of "Ilana" subdivision and determined
that all technical requirements contained in the Miami City Code Subdivision Regulations have been
met and has approved the tentative plat, The members of the Plat and Street Committee have further
considered the request for vacation and closure of the street with respect to Miami City Code
requirements and have voted 6 in favor and 0 in denial of this vacation and closure request, subject to
the following conditions:

a) The developer shall execute a covonent to run with the hand to maintain the proposed Tract A
located west of the NE 6 Avenue 50-foot wide roadway alignment.
b) The developer shall execute an agreement to maintain the proposed park (Tract C).
c) A platted development restriction to comply with the requirements of the Miami 21 Zoning Code
concerning the NE 31 Street view corridor,
In addition to the above requirements, you should be aware of the following:
1, State and locallaws require the installation of various physical improvements in the
public rightsmof way when property is platted. These subdivision improvements include
paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a
substantial investment on your part, REQUIRED: The submission of an electronic copy
of the tentative plat, in an AutoCAD version, to the City of Miami Public Works
Development and Roadway Plans Section will EXPEDITE the preparation and enhanee
the .ACCURACY of the subdivision improvement letter required for the final plat
approval,
2, The alteration, relocation or installation of utilities such as storm and sanitary sewers,
electric, telephone, water, ete caused by this plat will be at the property owner's expense.
Also; utility easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the final plat is
recorded or as authorized by City of Miami Code Section 55. 10(i), Also, the Certificate
of Occupancy for any building construction will be issued only after all the required
subdivision improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire Rescue Department
prior to the issuaannee of a building permit,
5. In order to mitigate problems associated with access and construction activities
throughout the neighborhood, the contractor/ developer is encouraged to notify the
affected neighborhood residents, in writing, of the project starting and completion dates
at the time of issuance of permits, The contractor/ developer may coordinate the
notification of residents with the local City of Miami NET Service Center,
6, Additional items must be provided to the City of Miami Department ofPublic Works
before the final plat is submitted to the City Commission for approval, You will be
notified in writing as to what these items are after the amount of the bond has been
determined for the necessauy subdivision improvements.
7. Tentative plat approval is only valid for one (1) year and six (6) months from the date of
the Plat and Street Committee meeting at which time it was approved.

and has approved the tentative plat. The Plat and Street Committee has further considered the vacation
and closure of a street located between NE 30 Terrace and NE 31 Street on the West side of Biscayne
Bay; and, also, between NE 31 Street and NE 32 Street on the West side of NE 7 Avenue, with respect to
the Miami City Code requirements and has voted to recommend approval 6 in favor and 0 in denial of
this vacation and closure request, subject to the following conditions: a) the developer shall execute a
covenant to un with the land to maintain the proposed Tract A located West of the NE 6 Avenue 50-foot
wide roadway alignment, b) the developer shall execute an agreement to maintain the proposed park
(Tract C) and c) a platted development restriction to comply with the requirements of the Miami 21
Zoning Code concerning the NE 31 Street view corridor.
