The alley is substandard in width and access is limited on the easterly end. The closure will reduce illegal activity and illegal dumping. 2. The alley is occasionally used by the adjacent property owners and utility companies. It is not regularly used by the general public and due to its restricted width and access, not generally used for emergency services. 3. There will be no adverse affect on the ability to provide emergency services. The abutting properties are shallow in depth and are served by improved streets along their frontage. 4. The alley is limited in width (15') and provides limited access and circulation for pedestrians and vehicles. The proposed plat dedicates additional right of way along NE 27 Street that will improve access and circulation in the neighborhood. 5. The Plat and Street Committee members voted to recommend 6 in favor and 0 in denial of this alley closure request. The Planning, Zoning and Appeals Board will require a sketch and legal description, with a square footage on an 8 'l2" X 11" paper, for the proposed closure. Utilities located within the alley to be closed and vacated must be relocated or easements provided. 9. Properly label the fractional description. 10. Delete the zoning information on the main sketch. 11. Provide an exception in the Surveyor's Notes that the flood elevation is in NGVD. 12. Provide a legal opinion, reviewed by the City Attorney's Office, on the City Code requirement that all owners of property abutting the alley to be closed and vacated shall be included in the plat and disposition of the alley. 13. The City Code requires that the subdivider provide on his property suitable access from the closed end of the alley to the nearest public right -of way. Provide documentation that demonstrates that suitable access will be provided to NE 27 Street. You may wish to consult the "Crimson Tower" development agreement with the City. 14. Show the existing underground storm drainage information including inverts, pipe size and pipe direction. 15. Provide elevations along the base building line and edge of pavement on 25' intervals. 16. A letter from Comcast is required to determine if any adjustments to their facilities or easements are required. 17. Verify with the Miami -Dade County that the proposed plat name is acceptable. 18. All encroachments across proposed tracts and/or lot lines must be removed prior to final plat submittal. 19. An Opinion of Title, in the City of Miami opinion of title form must be provided at the time of final plat submittal. 20. Current backup documentation will be required for all who execute the final plat. A resolution for authority to execute documents and a Certificate of Good standing from the Secretary of State are required, if applicable. 21. Tentative plat application must be made with Miami -Dade County after receiving approval from the City of Miami Plat and Street Committee. 22. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the owner's responsibility to work with his surveyor and his attorney to assure that everything is in order before submitting the final plat package. 23. Be advised that if all the requirements for scheduling the final plat for City Commission action are not in order, the final plat will not be scheduled for a City Commission meeting. 24. The Plat and Street Committee has reviewed the tentative plat of Rodriguez Subdivision and determined that all technical requirements contained in the Miami City Code Subdivision Regulations have been met and has approved the tentative plat. The members of the Plat and Street Committee have further considered the request for vacation and closure of the alley with respect to Miami City Code requirements and have voted to recommend 6 in favor and 0 in denial of this vacation and closure request. In addition to the above requirements, you should be aware of the following: 1. State and local laws require the installation of various physical improvements in the public rights -of -way when property is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility easements may be required on the property being platted. 3. A building permit will not be issued on the property being platted until the final plat is recorded or as authorized by City of Miami Code Section 55-10 (i). Also, the Certificate of Occupancy for any building construction will be issued only after all the required subdivision improvements have been completed. 4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the issuance of a building permit. 5. In order to mitigate problems associated with access and construction activities throughout the neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents, in writing, of the project starting and completion dates at the time of issuance of permits. The contractor/developer may coordinate the notification of residents with the local City of Miami NET Service Center. 6. Additional items must be provided to the City of Miami Department of Public Works before the final plat is submitted to the City Commission for approval. You will be notified in writing as to what these items are after the amount of the bond has been determined for the necessary subdivision improvements. 7. A tentative plat approval is only valid for one year and six months from the date of the Plat and Street Committee meeting at which time it was approved. The sole purpose of the replat is to vacate and abandon the substandard alley known as NE 27 Street Alley (the "Alley") immediately to the north of the Property. The Alley is substandard in width at 15' and fails to meet the City's 20' minimum requirement. Additionally, portions of the alley remain unpaved and, given the recent replats of the properties to the northeast and directly to the east of the Property, the Al- ley no longer provides viable connectivity to a public right of way on the east end of the Alley making it a dangerous dead-end without appropriate turn around or maneuvering space for automobiles or emergency service vehicles to enter or exit. To the northeast of the Property, the Related Group received approval from the City for the vacation of North Bayshore Drive and other surrounding rights of way. Shortly thereafter, Alpine Estates, LLC was granted approval for the vacation and clo- sure of a portion of the NE 27 Street Alley right of way immediately east of the Property. While the Crimson Plat includes an easement that would provide ingress/egress to the Alley through their private property, the sub -standard 15' width of the alley does not pro- vide for viable 2-way access to the Crimson Tower site, as contemplated in their plan, or allow for the proper turning radius to enter or exit the Alley at the eastern end without negatively impacting the existing properties. At it's current width, the Alley cannot sup- port the anticipated two-way traffic and vehicle trips. Additionally, the alley currently serves as an attractive nuisance where loitering, vandalism and other crimes frequently occur. This negatively impacts the area and property values. For these reasons, we are requesting the vacation and closure of the Alley. The City of Miami previously determined that the entire width of the 15' Alley was dedicated by Filer's Plat, Plat Book B, PAGE 6, recorded on December 27, 1897 which includes and identifies the "Public Road 15ft Wide" which is now identified as NE 27 Sheet Alley, see enclosed. Since the Alley was dedicated solely from the Filer's Plat, the reversionary interests in the 15' alley remain exclusively in the abutting owners to the south of the Alley and does not require the joining in the plat by the property owners to the North who are not a part of the original subdivision that dedicated the Alley.
