LLC and its affiliated entities in matters related to the development of the Miami Design District Retail Street Project (the "Project"). Previously, the City Commission approved several development orders related to the Project, most notably the Miami Design District Retail Street Special Area Plan (the "SAP"), certain land use modifications, and a companion development agreement consistent with the requirements of Sec. 3.9 of Miami 21. On behalf of our client, Design District Associates (Del.) LLC , its affiliated entities (collectively, the "Co -Applicant"), and our entire team, we are pleased to join the City of Miami ("City") in the submittal of this application to amend the SAP (the "SAP Amendment"). This amendment will incorporate an additional twelve parcels/folios - totaling approximately 1.98 acres — into the Project (the "Joined Parcels"). Ten (10) of the twelve (12) Joined Parcels are located to the west of current SAP boundary along N. Miami Avenue, NE Miami Court, and NE/NW 39'h Street. The remaining Joined Parcels are located at the NW and SE corners of NE 1" Avenue and NE 4151 Street. The joinder of the additional parcels increases the land mass of the SAP to 21.06 acres comprising the heart of the Design District. Approval of the SAP Amendment will increase the proposed development program by approximately 131 residential units, 117,472 sq. ft. of retail, and an additional 352 off-street parking spaces. Further refinements to the development program reflected in the SAP Amendment includes the proposed development of 350 residential units and 105,000 sq. ft. of retail/commercial space, supported by 875 off-street parking spaces, on the Tuttle North and Tuttle South sites. These programmatic additions result in a total development program for the Project consisting of approximately 1,150,000 sq. ft. of retail/commercial space, 180,000 sq. of office, 52 hotel rooms, and 561 residential units, all of which are supported by 3,068 off-street parking spaces and 124 bicycle parking spaces. akerman.com {25969062;1) Mr. Francisco Garcia March 13, 2013 Page 2 In addition to the above -listed programmatic elements, the application will expand the previously approved enhancements to the public realm to the areas abutting the Joined Parcels. Planned right-of-way improvements will significantly enhance the quality and design of the lighting, street furniture, and materials used throughout the Design District. Public art and enhancements to the area's tree canopy and landscaping will also form an integral part of plans to improve public spaces within the amended SAP boundary. The proposed SAP Amendment includes a change in the transect designation of two (2) lots within the existing SAP boundary — Tuttle North and South (See parcel 9 and 10 at pg. B.1.5 of the Concept Book) — from their current designation of T6-12 0 to T6-24 O. In addition, changes to the transect regulations for T4, T5, and T6, as well as related changes to Articles 1, 3, 4, 5, 6, 7, and 9 of Miami 21, that currently govern development on the subject parcels consist of further refinements to the previously approved language to eliminate ambiguities, as well changes to the governing standards. The requested revisions will further facilitate the area's redevelopment and the advancement of a Project that will cement the Design District's standing as the premier luxury shopping destination in South Florida through its unique combination of community, retail shopping, arts, and design. Finally, the proposed SAP Amendment further increase the anticipated number of temporary and permanent jobs generated by the Project, It will also expand the tremendous recurring fiscal benefits to the City of Miami realized in the form of ad valorem tax remittances, parking surcharge receipts, and sales tax remittances. Most importantly, approval of the SAP Amendment will further bolster Miami's growing standing internationally as an important urban center for commerce and culture, For the foregoing reasons, we respectfully request the City's approval of the SAP Amendment and revised and restated Agreement.
