A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING AN EXCEPTION REQUIRING CITY COMMISSION, AS LISTED IN
CHAPTER 4 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, ENTITLED,
"ALCOHOLIC BEVERAGES" AND ARTICLE 4, TABLE 3, OF ORDINANCE NO.
13114, THE MIAMI 21 CODE, THE ZONING ORDINANCE OF THE CITY OF MIAMI,
FLORIDA, ENTITLED, "BUILDING FUNCTIONS: USES" TO ALLOW AN
ALCOHOLIC BEVERAGE SERVICE ESTABLISHMENT IN A "D-2" INDUSTRIAL
DISTRICT ZONE, SUBJECT TO ALL APPLICABLE CRITERIA, FOR THE
PROPERTY LOCATED AT APPROXIMATELY 1915 NORTHWEST MIAMI COURT,
MIAMI, FLORIDA.
WHEREAS, the Miami Planning, Zoning and Appeals Board, at its meeting on September 23,
2013, following an advertised public hearing, adopted Resolution No. PZAB-R-13-044 by a vote of
eight to zero (8-0), item no. 2, recommending APPROVAL with a condition of the Exception requiring
City Commission approval as follows: A parking lease and valet agreement in a form acceptable to
the Zoning Administrator must be submitted prior to issuance of any Building Permits or Certificate of
Use; and
WHEREAS, Chapter 4 of the Code of the City of Miami, Florida, as amended, requires City
Commission approval of an Exception; and
WHEREAS, the City Commission after careful consideration of this matter, finds the application
for Exception requiring City Commission meets the applicable requirements of Ordinance No. 13114,
the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"), and deems it
advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to
approve the Exception as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Exception requiring City Commission, as listed in Chapter 4 of the Code of the City
of Miami, Florida, entitled, "Alcoholic Beverages" and Article 4, Table 3, of Ordinance No. 13114, the
Miami 21 Code, the Zoning Ordinance of the City of Miami, Florida, entitled, "Building Functions:
Uses", to allow an alcoholic beverage service establishment in a "D2" Industrial District Zone, subject
to all applicable criteria, for the property located at approximately 1915 Northwest Miami Court, Miami,
Florida, legally described in attached "Exhibit A," pursuant to plans on file and subject to a time
limitation of twelve (12) months in which a building permit must be obtained, is approved and the
Exception is granted. This Exception is granted with the following conditions: last call for drinks shall
occur no later than 4:00 a.m. and the building will close to all patrons and the public no later than 5:00

Section 3. The Applicant may reqest upon payment of any prescribed public hearing fees, the City
Commission to modify the conditions in Section 2 above from September 2014 or later.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1 }
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
