September 23, 2013 ANALYSIS FOR EXCEPTION HOUSE BANQUET HALL APPROXIMATELY AT 1915 N.W MIAMI COURT File No. 13-00899xc This proposal seeks an Exception with City Commission approval pursuant to Article 4, Table 3 and Chapter 4 of the City Code, to allow an Alcohol Beverage Service Establishment, specifically a Supper Club located within an Industrial District Zone (D2). Application request: To allow a Super Club with live entertainment in an existing warehouse of approximately 7,400 square feet with a maximum seating capacity of 1,200 persons. The application also includes allowing outdoor seating area and offsite parking within a distance of 1,000 feet from the subject establishment. The subject parcel is located within the Wynwood/Edgewater NET area, encompassing Lot 10 and the west IA of Lot 11, Block 20 of Waddell Addition as described in Exhibit "A" (Complete legal description in on file with the Hearing Boards Section). This EXCEPTION Permit encompasses the following permits request: WARRANT pursuant to Article 6, Section 6.3.2(1), to allow an outdoor seating area of approximately 1,576 square feet of floor area. WARRANT as per City Code Chapter 4, Section 4-3.2(b), to allow the required parking to be located offsite within a distance of 1,000 feet from the subject establishment. Review and analysis of the proposed application finds that: • The proposed property is located within the Industrial District Zone D2 and close to the Wynwood Cafe Entertainment District. • The Exception application is to allow an alcohol beverage service establishment using a 4COP SRX alcoholic beverage license, specifically a supper club within an existing warehouse. • The existing structure comprises a one story building of approximately 7,400 square feet, which entitles a seating capacity of 1,200 persons containing bar counters, food preparation area, seating throughout the establishment, live entertainment area and outdoor seating area. • Pursuant to Article 4, Table 4 commercial use requires a minimum of 3 parking spaces per 1,000 square feet, which constitutes approximately 24 parking spaces for 7,400 square feet of commercial area. • The applicant will be providing twenty-nine (29) parking spaces on the paved lot behind the building, in addition, they will provide forty-three (43) spaces in a lease lot across the building and three hundred (300) additional parking spaces on three (3) acre lot on the west side of NW 1st Avenue. • The applicant has submitted the necessary information which has been attached to this file and is considered an official part of this file on record with the Hearing Board Office and complies with the guidelines and criteria required for this type of permit specified on Sec, 4-3.2 of the City Code. • As it pertains to the 200' ft distance standard set forth in Sec. 4-3,2(h) of the City Code, computed along the route of ordinary pedestrian traffic; the proposed establishment is approximately 628' feet away from the nearest residential use. • The use is compatible and beneficial to the area by providing an entertainment service to the community. With respect to all additional criteria as specified -on -Section 4, Table-12-of Miami 21 Ordinance, and Chapter 4, Sec 4-3.2 of the City Code, the proposal has been review and found to be adequate. Based on these findings, the Planning and Zoning Department is recommending approval of the application with the following condition, which must be satisfied prior to the issuance of any Building Permits: 1. A parking lease and valet agreement in a form acceptable to the Zoning Administrator must be submitted prior to issuance of any building permits or Certificate of Use. An operational/business plan that addresses hours of operation, number of employees, menu items, goals of business, and other operational characteristics pertinent to the application. HOUSE is not just another nightclub or event space. It is truly a home, with kitchens as bar, showers as VIP and art that physically responds to people. The entire space is surrounded by 360 degrees of panoramic projections, 3D Architectural mapping, and holographic and fogscreen technology. HOUSE has technology that has never been used before in a nightclub environment. It is a revolutionary space, where everyone is welcome. HOUSE will operate between the hours of 11:00 PM and 5:00 AM daily. With many successful venues under our belt, including most recently, Living Room in Fort Lauderdale, we have a large and loyal clientele. There is already a tremendous amount of anticipation for HOUSE's opening. There will be a strict dress code, but our prices will be reasonable. The intent is to expose people and bring business to this area. The target patron is aware and appreciates the arts. Planned art shows in the afternoons will give local artists the opportunity to showcase their work in a unique setting. A parking plan which fully describes where and how the parking is to be provided and utilized, e.g., valet, self -park, shared parking, after -hour metered spaces, and the manner in which the parking is to be managed. By Class II permit (in addition to the Class II permit required for the subject establishment), 100 percent of the required parking may be located offsite within a distance of 600 feet from the subject establishment if the proposed parking is to be "self -park," and a distance of 1000 feet from the subject establishment if the proposed parking is to be by "valet". The proposed parking plan is as follows: 1. Applicant will utilize the paved lot behind the building as valet which contains twenty-nine (29) spaces which are shown on the plan. 2. In addition they will also lease the paved lot directly across from building which has forty-three (43) spaces. 3. Finally, the Applicant intends to lease the three (3) acre lot on the west side of NW 1st Avenue, which will provide approximately 300 additional parking spaces. For establishments proposing capacities over 300 persons, an indoor/outdoor crowd control plan that addresses how large groups of people waiting to gain entry into the establishment, or already on the premises, will be controlled. Our philosophy as a business has always been to get customers inside the venue in a quick and orderly fashion. We are in a warehouse district with no comforts or air conditioning for the patrons. It is not acceptable to leave patrons sitting outside in the sweltering heat waiting endlessly to come inside. There will be sufficient security to property ID patrons and get them in promptly. Once inside, there will be sufficient amount of security to properly control the crowd and make sure that our patrons have a safe and positive experience. Our requirements at the door will be strictly enforced with dress code, etc. A security plan for the establishment and any parking facility. The club's maximum occupancy is 1,200 persons. The traffic circulation analysis is attached. A sanitation plan, which addresses on -site facilities as well as off -premises issues resulting from the operation of the establishment. There will not be any service of foods, therefore the garbage produced will consist mostly of cups, napkins, and basic items. There will be one large dumpster in the back that will be changed weekly. Additionally, staff will clean any potential garbage from. our patrons on the streets, etc. Proximity of proposed establishment to residential uses. First and foremost, we have no open businesses or residential neighbors in the vicinity. Our philosophy as a business has always been to get customers inside the venue in a quick and orderly fashion. We are in a warehouse district with no creature comforts or AC outside for our patrons. It isn't acceptable to leave them sitting outside in the sweltering heat waiting endlessly to come in. We are very hopeful that we can bring new life and clientele to an area that is currently deserted at night ( with the exception of the homeless population). That being said, we will have sufficient security to properly ID guests and get them in promptly. Once inside, we again have the sufficient amount of security to properly control the crowd , making sure our guests have a safe and positive experience. We want to try and bring a sophisticated clientele to this area. Our requirements at the door will be strictly enforced with dress code etc. It's not about whether people spend.5 dollars or 5,000 simply, that people took the time to get dressed to come out. We have signed a 20 year -lease, so our intention is to be here for the long haul. We will never be the club that opens for the sake of opening just for short term gain.
