Dear Mr. Rodriguez, The undersigned is the authorized legal representative for the Southeast Overtown/Park West Community Redevelopment Agency ("SEOPW") and The Black Archives Historic & Research Foundation of South Florida ("Black Archives") in connection with the right of way vacation and road closure associated with the Lyric Plat. The SEOPW and Black Archives have, for several years, collaborated to assemble and clear title to Block 36 in the heart of the SEOPW area, The centerpiece of this property is the Historic Lyric. Theater a National Register of Historic Places site and also the future home of the The Black Archives Lyric Theater Welcome Center, The two, 10 foot alleys, and the 40 foot wide right of way have not been used for pedestrian access, vehicular access, police, fire, solid waste and/or emergency services in recent memory. They have been used as surface parking lots and, on plain view, cannot be identified in person or via visual inspection of aerial photography. I West Palm Beach Mr. Anel Rodriguez June 27, 2013 Page 2 The vacation of these areas will accomplish several important goals. First, it will permit the re -platting of the master parcel into properties that will correlate the ownership by SEOPW of the Historic Lyric Theater site and the ownership by The Black Archives of a platted parcel. This new plat will also create parcels that will accommodate the future development of the balance of the property into a garage to serve the Lyric Theater and a mixed use development. The tentative plat proposing these new parcels as well as the right of way closings were originally filed several years ago. Unfortunately, the process was derailed, among other things, by litigation between Miami Dade County (the predecessor in title to some of the abutting properties) and the SEOPW. During the pendency of that case, the original Tentative Plat expired. The parties have since settled their disagreements and the lands at issue are all now owned by the SEOPW. The re -platting of the lands and the vacation of the alleys and right of way will kick start the rebirth of the Lyric Theater and The Black Archives Welcome Center to historic Overtown. At its meeting of the Miami Plat and Street Committee of February 7, 2013, the committee voted 5 -0 in favor of the right of way vacation requested. The vacation of this right of way meets the criteria established in Section 55-15 of the City's Code of Ordinances for the closure and vacation of streets, alleys and other public rights of way, as follows: (1) Is it in the public interest, or would the general public benefit from the vacation of the rights -of -way or easements? There is great public benefit to vacating two minor alleys and a 40 foot wide right of way that provides no access or connectivity to the community in exchange for the ability to complete the revitalization of the heart of the SEOPW CRA with the Historic Lyric Theater and The Black Archives as well as a garage for the Lyric Theater, and a much anticipated mixed use project for the area. (2) Is the general public no longer using the rights -of -way or easement, including public service vehicles such as trash and garbage trucks, police, fire or other emergency vehicles? Yes, the general public does not use the right of way. Public Service vehicles not only do not use the areas for service access, they, in fact, do not have access as these areas are currently gated off. (3) Would there be no adverse effect on the ability to provide police, fire or emergency services? (4) Would the vacation and closure of the rights -of -way or easements have a beneficial effect on pedestrian and vehicular circulation in the area? The vacation and closure of the rights of way will benefit pedestrian circulation. Proposed Tract D (2.03 acres), which will be possible with of the vacation of the 10 foot wide alley and the 40 foot wide right of way (referred to as NW 1st Court) will be developed with a mixed use project that will incorporate the Miami 21 Code vehicular and pedestrian principles of the T6-24-0 Transect. State and local laws require the instaliafion of various physical improvements in the public rights -of -way when property is platted.
