HomeMy WebLinkAboutR-13-0406City of Miami Legislation Resolution: R-13-0406 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-01063 Final Action Date: 10/10/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AN ADDITIONAL OWNER CONTINGENCY ALLOWANCE TO PEREZ-GURRI CORPORATION D/B/A N&J CONSTRUCTION, FOR THE CARIBBEAN MARKETPLACE RENOVATIONS PROJECT, B-30671, TO COVER THE NECESSARY WORK FOR RECENTLY DISCOVERED UNFORESEEN ROOF AND STRUCTURAL DAMAGE/DEFICIENCIES, IN AN AMOUNT NOT TO EXCEED $48,110.83, THEREBY INCREASING THE AWARD VALUE FROM $883,582.45, TO AN AMOUNT NOT TO EXCEED $931,693.28; ALLOCATING FUNDS FOR SAID INCREASE FROM CAPITAL IMPROVEMENT PROJECT NO. B-30671, SUBJECT TO BUDGETARY APPROVAL. WHEREAS, pursuant to Resolution No. 12-0273, adopted July 26, 2012, the City Commission authorized the execution of a Contract with Perez-Gurri Corporation d/b/a N&J Construction ("N&J") for the Caribbean Marketplace Renovations Project, B-30671 ("Project"), in the amount of $831,869 for the scope of work, plus a five percent (5%) owner contingency amount of $41,593.45, for a total not to exceed award value of $873,462.45; and WHEREAS, pursuant to Resolution No. 13-0233, adopted June 13, 2013, the City of Miami ("City")executed Amendment No. 1 which increased the award value in the amount of $10,120, from $873,462.45 to an amount not to exceed $883,582.45, for additional work due to unforeseen conditions such as repairs to the existing strap concrete beam, change of size of the exterior door and frame and the addition of a new backflow preventer and City Department of Fire connection line; and WHEREAS, an additional owner contingency allowance, in the amount of $48,110.83 is being requested to cover the work for recently discovered unforeseen roof and structural damage/deficiencies necessary for completion of the Project; and WHEREAS, funds are to be allocated from Capital Improvement Project No. B-30671, subject to budgetary approval; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An additional owner contingency allowance to N&J, for the Project, to cover the necessary work for recently discovered unforeseen roof and structural damage/deficiencies, in an amount of $48,110.83, thereby increasing the award value from $883,582.45, to a total amount not to exceed $931,693.28, is authorized, with funds for said increase, allocated from Capital Improvement City of Miami Page 1 of 2 File Id: 13-01063 (Version: 1) Printed On: 9/19/2017 File Number: 13-01063 Enactment Number: R-13-0406 Project No. B-30671, subject to budgetary approval. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
