A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING A QUIT CLAIM DEED, IN SUBSTANTIALLY THE ATTACHED FORM,
FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), FOR THE
TRANSFER OF SOUTHEAST 1ST AVENUE BETWEEN SOUTHEAST 5TH STREET
AND SOUTHEAST 6TH STREET, MIAMI, FLORIDA, FROM FDOT TO THE CITY OF
MIAMI ("CITY") STREET SYSTEM; FURTHER REQUESTING THAT FDOT
RECORDS SAID QUIT CLAIM DEED IN THE PUBLIC RECORDS OF MIAMI-DADE
COUNTY, FLORIDA, AND PROVIDES A RECORDED COPY TO THE CITY.
WHEREAS, at the urging of the City of Miami ("City"), the Florida Department of Transportation
("FDOT") acquired a parcel of land for the Miami Avenue Bridge and Transition, Project FM 251039-1,
in the 1980's in order to provide a vehicular and pedestrian connection between Southeast 5th Street
and Southeast 6th Street aligning with the street grid pattern of Southeast 1st Avenue, Miami, Florida;
and
WHEREAS, as part of the South Miami Avenue bridge reconstruction project, Miami -Dade County
constructed a two lane roadway upon FDOT's acquired parcel of land to provide the connection
needed for access to the local neighborhood; and
WHEREAS, the City has been maintaining the roadway since 1988, although title for the land
remained in the name of FDOT; and
WHEREAS, FDOT desires to formally transfer Southeast 1st Avenue between Southeast 5th
Street and Southeast 6th Street, Miami, Florida, to the City and this transfer is mutually agreed upon
between the City and FDOT;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. A Quit Claim Deed, in substantially the attached form, from FDOT, is accepted, for the
transfer of Southeast 1st Avenue between Southeast 5th Street and Southeast 6th Street, Miami,
Florida, from FDOT to the City street system.
Section 3. The Miami City Commission further requests that FDOT records said Quit Claim Deed
in the public records of Miami -Dade County, Florida, and provides a recorded copy to the City.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
