HomeMy WebLinkAboutR-13-0376City of Miami Legislation Resolution: R-13-0376 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00969 Final Action Date: 9/26/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE ("LICENSE"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND TROPICAL FINANCIAL CREDIT UNION, A FEDERALLY CHARTERED CREDIT UNION, FOR THE USE OF APPROXIMATELY 20 SQUARE FEET OF SPACE IN CITY -OWNED PROPERTY, LOCATED AT 444 SOUTHWEST 2ND AVENUE, MIAMI, FLORIDA, ALSO KNOWN AS THE MIAMI RIVERSIDE CENTER ("PROPERTY"), FOR THE PURPOSE OF OPERATING AND MAINTAINING AN AUTOMATIC TELLER MACHINE, ON A MONTH -TO -MONTH BASIS, FOR A MONTHLY USE FEE PAYMENT OF FIVE HUNDRED DOLLARS ($500), PLUS STATE OF FLORIDA USE TAX (IF APPLICABLE), WITH TERMS AND CONDITIONS MORE PARTICULARLY SET FORTH IN THE LICENSE. WHEREAS, the City of Miami ("City") is the owner of real property and improvements located at 444 Southwest 2nd Avenue, Miami, Florida also known as the Miami Riverside Center ("Property"); and WHEREAS, Tropical Financial Credit Union ("Licensee"), a federally chartered credit union, operated a credit union branch office of approximately 140 square feet of space on the third floor of the Property and a free-standing automatic teller machine ("ATM") on the first floor of the Property under a Revocable License Agreement ("RLA"), dated March 10, 1997 with the City; and WHEREAS, Licensee reorganized its operations and closed its branch office at the Property; and WHEREAS, Licensee notified the City that it was canceling its RLA with the City but wished to continue to operate and maintain its ATM on the first floor of the Property; and WHEREAS, a new Revocable License ("License") with the Licensee shall allow the Licensee to continue operating an ATM on the first floor of the Property; NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{ 1; to execute a License, in substantially the attached form, between the City and Licensee, a federally chartered credit union, for the use of approximately 20 square feet of space in City -owned Property, for the purpose of operating and maintaining an ATM, on a month -to -month basis, for a monthly Use Fee payment of Five Hundred Dollars ($500) plus State of Florida Use Tax (if applicable), with terms and conditions more particularly City of Miami Page 1 of 2 File Id: 13-00969 (Version: 2) Printed On: 9/18/2017 File Number: 13-00969 Enactment Number: R-13-0376 set forth in said License. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. }2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
