WHEREAS, due tothe continuing negative impact ofthe economy, many businesses have allowed their Certificates nfUse holapse; and VVHEF{EA8, many business owners who allowed their Certificates ofUse tn lapse were ungvvona of the Nonconforming Use Pilot Program; and WHEREAS, Section 2-212(a)ofthe Code ofthe City ofMiami Florida, osamended yCit«Code"\ created the Nonconforming Use Pilot Program hJ provide for an annnaatv period in which business owners may apply for a Certificate of Use fora nonconforming use after allowing their certificate of use to lapse; and WHEREAS, the extension provide for in Section 2-212(a) of the City Code expired on August 1, 2013, but may be extended by affirmative vote of the City Commission; and WHEREAS, the City of Miami ("City") wishes to increase public knowledge of the existence of the Nonconforming Use Pilot Program and to provide an extended period of time to use said program; and WHEREAS, the City Commission deems it advisable to extend the Nonconforming Use Pilot NOW, THEREFORE, BE|TRESOLVED BYTHE COMMISSION OFTHE CITY OFK4|AN|. FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The K8kanni City Commission extends the Nonconforming Use Pilot Program related to lapsed Certificates nfUse until August 1.2015. Section 3.
