and 2740 SW 27th Court.

Pursuant to Article 5 of Ordinance 13114, as amended, the Zoning Ordinance of the City of Miami, Florida, the
subject proposal has been reviewed for an amendment to the Zoning Atlas as follows:
Application requests:
A change to the existing zoning classifications of the acreage described herein of selected real properties
located approximately 2701, 2721, and 2751 SW 28th Avenue, Miami, Florida from "T3-0" Sub -Urban —
Open Transect Zone to "T4-0" General Urban — Open Transect Zone.
The subject area is located within the Coral Way NET area and consists of three parcels as described in Exhibit "A"
(Complete legal description is on file with the Hearing Boards Section).
Review and analysis of the proposed application finds that:
• The subject properties comply with Section 7.1.2.8 (a) of the Miami 21 Code, since the rezoning is proposed to
the next higher Transect Zone.
• The request is deemed in compliance with Section 7.1.2.8 (c) of the Miami 21 Code, since the shape of the
aggregate of the parcels proposed for rezoning has more than two hundred feet of Street Frontage on one (1)
street.
• The proposed rezoning is in compliance with Miami 21 Code principle, generating appropriate transitions in
height, scale, density and intensity of transects north to south and east to west.
• The proposed rezoning does not require land use change.
• The subject properties are within one-half (1/2) mile radius from a convergence of modes of transit, constituting
a Transit Oriented Development (TOD) pursuant to Miami 21, Article 1.2 Definitions of Terms.
Based on the aforementioned findings, the Planning and Zoning Department recommends approval
of the proposal as presented.

Analysis for ZONING CHANGE

adjacent property in accord with existing regulations.
n) The proposed change conveys the same treatment to the individual owner as
to owners within the same classification and the immediate area and furthers the
protection of the public welfare.
o) There are substantial reasons why the use of the property is unfairly limited
under existing zoning.
p) It is difficult to find other adequate sites in the surrounding area for the
proposed use in districts already permitting such use.

Court from T3-O to T4-O (collectively, the "Property")
Dear Mr. Rodriguez,
The undersigned is the authorized legal representative for Landaq, Inc. and Grove Bluff
LLC (collectively referred to as "Owners"). The Owners are the legal owners of ten (10)
contiguous lots located on the south side of S.W. 27th Street between SW 28th Avenue and S.W.
28th Court. The aggregated parcels are more specifically described in Exhibit "A" to the
application ("Property").
This application seeks the rezoning of all properties from T3-O to T4-O. This request meets the
requirement of Section 7.1.2.8 of the Miami Zoning Ordinance, ("Miami 21 Code"), in that the
Property contains more than 200 lineal feet of frontage, to wit, 203 linear feet along SW 27
Court and 302.7 linear feet along SW 28 Avenue. The lands comprise 38,768 square feet of
area (± 0.89 acres).
The requested zoning change is consistent with the designation for all of lots that
comprise the Property in the City's Comprehensive Neighborhood Plan, Future Land Use Plan.
The entire Property is designated General Commercial is the Future Land Use Plan map. The
requested rezoning of the properties to T4-O ("Urban Center") or a higher density transect is
consistent with the General Commercial land use designation. Just as important, the City's
Comprehensive Neighborhood Plan also includes the Property within at Transit Oriented
Development area for the Coconut Grove Station on US1 and SW 27 Avenue.

The area surrounding the Coconut Grove Metrorail Transit station is one of the most
underdeveloped and underutilized areas in the City. Rezoning of the Property to a higher density
transect will permit the development of the Property at a higher residential density within a
development that is compatible with the surrounding established low density residential
neighborhoods to the south. The T4-O transect provide an transitional buffer from the T5-O
designated properties to the east and to the south. The proposed rezoning is precisely what the goal
of Miami 21 and the Transect Principles set forth in Section 2.1.3 of Miami 21.
Furthermore, the rezoning of the Property to a transect that permits higher residential density
in close proximity to the Coconut Grove Station (within less than 500 feet) is consistent with the
planning and future land use policies of the City's Comprehensive Neighborhood Plan.
Policy LU-1.1.10: The City's land development regulations will encourage high density residential
development and redevelopment in close proximity to Metrorail and Metromover stations. (See
Transportation Policy TR-1.5.2 and Housing Policy HO-1.1.9.)
Policy TR-1.5.2: The City shall conduct appropriate land use and zoning analysis of the areas
surrounding each existing and future premium transit station as such station sites are approved by
Miami -Dade County or the City of Miami for development in order to determine whether appropriate
land use and zoning changes should be implemented that foster the development and use of the
stations while protecting adjacent neighborhoods from incompatible development (examining height,
density and intensity, use and scale). Such land use and zoning changes shall include minimum and
maximum density and intensity standards at the time of implementation.
A. The City shall encourage development of a wide variety of residential and non-residential land -
uses and activities in nodes around rapid transit stations to produce short trips, minimize transfers,
attract transit ridership, and promote transit operational and financial efficiencies. Land uses that
may be approved around transit stations shall include housing, shopping, and offices in moderate to
high density and intensity, complemented by compatible entertainment, cultural uses and human
services in varying mixes. The particular uses that are approved in a given station area should
respect the character of the nearby neighborhood, strive to serve the needs of the neighborhood, and
promote balance in the range of existing and planned land uses along the subject transit line.
B. It is the policy of the City of Miami to accommodate new development around rapid transit
stations that is well designed, conducive to both pedestrian and transit use, and architecturally
attractive. In recognition that many transit riders begin and end their trips as pedestrians, pedestrian
accommodations shall include, as appropriate, continuous sidewalks to the transit station, small
blocks and closely intersecting streets, buildings oriented to the street or other pedestrian paths,
parking lots predominantly to the rear and sides of buildings, primary building entrances as close to
the street or transit stop as to the parking lot, shade trees, awnings and other weather protection for
pedestrians.

G. The City of Miami seeks to increase the density of development within walking distance of rapid
transit stations in a manner appropriate to the particular setting of each transit station and
consistent with the policies of the MCNP that speck that existing abutting residential neighborhoods
are to be protected and preserved.
Accordingly, the rezoning of the Property to an appropriate transect with higher
residential and development density is consistent with the adopted Transit Oriented Development
designation for the Property in the Miami 21 Zoning Code, the General Commercial land use
designation in the Future Land Use Plan of the Comprehensive Neighborhood Plan, the land use
and transportation policies of the City's Comprehensive Neighborhood Plan and the transect
planning principles of Miami 21.
Based on the foregoing, we respectfully request the favorable review and
recommendation by the Planning Director.

Miami 21, Article 7.1.2.8, c.2 (2) Analysis
The accompanying materials provide an analysis of the properties within a half
mile radius of the subject property and provide planning and zoning support for
the requested change in zoning transect.
Exhibit 1.1 is an aerial of the Property depicting the site's proximity to the
Coconut Grove Metro Rail station, US 1 and high density multifamily
residential projects along S.W. 27th Avenue in immediate, inappropriate,
proximity to single family and duplex residential homes.
Exhibit 1.2 depicts the Property's designation as "General Commercial" in the
City's Future Land Use Plan Map to the Comprehensive Neighborhood Plan.
Exhibit 1.3 is a Map IV.26 of the City's Comprehensive Neighborhood Plan
wherein the Property is included within the 1/4 pedestrian shed area for the
Coconut Grove Metrorail station.
Exhibit 1.4 provides an analysis of the scale of proposed zoning as an
appropriate transition between the approved intensity and height of the property
to the north and the duplex and single family residential properties to the south.
The proposed transect complies and promoted the Transect Principles guiding
the Miami 21 Code, as set forth in Section 2.1.2 of Miami 21.
Exhibit 1.5 provides a graphic summary of the historic development of the area
since the Coconut Grove Metro Rail Station was built (1986). The area has not
experienced significant development or redevelopment of single family or
duplex residences as permitted under the T3-O Transect (or its previous R-2
zoning under Ordinance 11000).

Pursuant to State Statutes and the Interlocal Agreements for Public School Facility Planning in Miami -
Dade County, the above -referenced application was reviewed for compliance with Public School
Concurrency. Accordingly, enclosed please find the School District's Preliminary Concurrency Analysis
(Schools Planning Level Review) for informational purposes only.
As noted in the Preliminary Concurrency Analysis (Schools Planning Level Review), the proposed
development would yield a maximum residential density of 32 multi -family attached units, which
generate 4 students; 2 elementary, 2 middle and 2 senior high students. At this time, all three school
levels have sufficient capacity available to serve the application. However, a final determination of
Public School Concurrency and capacity reservation will only be made at the time of approval of final
plat, site plan or functional equivalent. As such, this analysis does not constitute a Public School
Concurrency approval.

Welcome to the City of Miami! This application is intended to serve as a guide in assisting you
with our public hearing process. Please feel free to contact us, should you have any questions.
There is no deadline to submit this application as it is presented semi-annually to the Planning,
Zoning and Appeals Board and the City Commission. The application submittal date is the
date stamped by Hearing Boards' staff on this page. The responses to this application must
be typed and signed in black ink. All pertinent and accurate information/documentation; i.e.,
the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt.
The applicant is responsible for the accuracy of the information contained in the application and
all supporting materials. Should you wish, you could bring the materials to our office for review
prior to submittal to ensure completeness.
You will be responsible, if needed, to bring an interpreter for the English language to any
presentation before city boards, committees and the city commission. A valid power of attorney
will be required if neither applicant or legal counsel representing the applicant execute the
application or desire to make a presentation before city boards, committees and the city
commission. All documents, reports, studies, exhibits (8%x11 ") or other materials submitted
during this process will be kept as part of the record. Any documents offered to the Planning,
Zoning and Appeals Board and the City Commission, which have not been provided fifteen (15)
days before the meeting as part of the agenda materials will be entered into the record at the
discretion of the aforementioned Board and Commission.
ORDINANCE NO. 11469, CODIFIED IN CHAPTER 2, ARTICLE VI OF THE CITY CODE
STATES THAT ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR
EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST
WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY
STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. A COPY OF SAID
ORDINANCE IS AVAILABLE IN THE OFFICE OF THE CITY CLERK (MIAMI CITY HALL),
LOCATED AT 3500 PAN AMERICAN DRIVE, MIAMI, FLORIDA, 33133.
Ordinance No. 12918 states that each person or entity requesting approval, relief or other action
from the City Commission or any of its boards, authorities, agencies, councils or committees
regarding any issue, shall disclose at the commencement (or continuance) of the public
hearing(s) on the issue, any consideration provided or committed, directly or on its behalf, for an
agreement to support or withhold objection to the requested approval, relief or action. The
Disclosure of Consideration Provided or Committed for Agreement to Support or Withhold
Objection Affidavit included in this package must be submitted with the application. The
applicant must, at the commencement of any public hearing on the issue, if there is any
disclosure to report, read the disclosure into the record. Also, the applicant must supplement
the affidavit if there is any new information or additional information to disclose.

FURTHER RESOLVED, that the Board of Trustees of the Corporation shall or have, if
required, prior to the closing the sale and conveyance of the Property obtain approval for
such sale and conveyance by appropriate means from such number of members of the
Corporation as required by the terms and provisions of the Articles of Incorporation and the
By Laws of the Corporation; and
FURTHER RESOLVED, that Bruce W. Greer and Joyce Burns, President and
Secretary respectively of the Corporation, are hereby authorized and directed to execute on
behalf of the Corporation a Warranty Deed, any Affidavit propounded by the Purchaser the
contents of which are accurate; the Closing Statement; and any and all other instruments and
documents as may be required by Purchaser in order to close the sale and conveyance and to
do such other acts and things as may be necessary or advisable in order to carry out and
perform on the part of this Corporation the covenants, conditions and agreements on its part
to be carried out and performed, and in order to carry out and give effect to the full intent and
purposes of these resolutions; and

FURTHER RESOLVED, that the Secretary of this Corporation shall certify to Lender the
names of the present duly elected and qualified officers of this Corporation; and
FURTHER RESOLVED, that the foregoing resolutions shall remain in full force and effect
until written notice of their amendment or rescission shall have been received by the Lender
or its agents, and that receipt of such notice shall not affect any obligations entered into by
this Corporation prior thereto or action taken by the Lender prior thereto; and
LASTLY RESOLVED, that the Secretary be, and hereby is authorized and directed to
certify to the Lender the passage of the foregoing resolutions and to certify that the
provisions thereof are in conformity with the Articles of Incorporation, the By -Laws, other
Resolutions of the Corporation, and all other corporate governing documents (collectively
referred to herein as the "Governing Documents").
I HEREBY CERTIFY to Lender that:
1. The Corporation is in good standing and validly exists within the State of Florida as
a not -for -profit corporation on the date hereof; and
2. That there are no proceedings of any nature whatsoever relating to the bankruptcy,
merger, liquidation or dissolution of the Corporation pending or contemplated; and
3. That the foregoing Resolutions of the Board of Trustees of the Corporation have not
been amended or rescinded in any manner, are in full force and effect as of the date hereof, are not
inconsistent with any provisions of the Governing Documents currently in effect and are within the
power of the Board of Trustees to pass as provided in the Governing Documents and under Florida
law, and that there is no provision in the Governing Documents limiting the power of the Board of
Trustees to pass the foregoing resolutions; and.
4. That the Governing Documents have not been amended, altered (except as to copies
of any of same as have been provided to Lender) or rescinded and are in full force and effect as ofthe
date hereof with no amendments thereto proposed or pending: and
5. That appended hereto (or previously furnished to the Purchaser) are true, accurate and
complete copies ofthe Articles of Incorporation and By Laws ofthe Corporation and all amendments
thereto; and
6. That the Corporation has the power to sell and convey its real property and no
contrary provision exists in the Governing Documents and that the President of the Corporation has
full authority to bind the Corporation consistent with the above resolutions; and
