HomeMy WebLinkAboutR-13-0303City of Miami Legislation Resolution: R-13-0303 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00783 Final Action Date: 7/25/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO INVESTIGATE THE LEGAL AND LOGISTICAL ISSUES INVOLVED IN THE IMPLEMENTATION OF A FICA ALTERNATIVE PROGRAM FOR ALL TEMPORARY, SEASONAL AND PART-TIME EMPLOYEES AND TO PREPARE A WRITTEN REPORT TO THE CITY COMMISSION WITHIN SIXTY (60) DAYS. WHEREAS, the City Commission would like to explore the implementation of a FICA Alternative Retirement Program for all temporary, seasonal and part-time employees; and WHEREAS, employees participating in the City of Miami's ("City's") FICA Alternative Plan would pay 7.5% of their pre-tax wages into a private retirement plan instead of Social Security; and WHEREAS, employees participating in the City's FICA Alternative Plan would have the ability to decide how their retirement money should be invested; and WHEREAS, benefits earned under other retirement plans, including Social Security, would not be reduced by an employee's participation in the City's FICA Alternative Plan; and WHEREAS, other government entities including the State of Florida, Florida State University, the University of Florida, and Florida International University have implemented FICA Alternative Plans in recent years; and WHEREAS, the City Commission would like a written report on the legal and logistical issues involved in establishing a FICA Alternative Retirement Plan; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is directed to investigate the legal and logistical issues involved in the implementation of a FICA Alternative Retirement Plan for all temporary, seasonal and part-time employees, and to prepare a written report to the City Commission within sixty (60) days. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: City of Miami Page 1 of 2 File Id: 13-00783 (Version: 21 Printed On: 9/6/2017 File Number: 13-00783 Enactment Number: R-13-0303 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
