HomeMy WebLinkAboutR-13-0299City of Miami Legislation Resolution: R-13-0299 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00837 Final Action Date: 7/25/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING IN ITS ENTIRETY, RESOLUTION NO. 13-0216, ADOPTED JUNE 13, 2013; AUTHORIZING THE PURCHASE AND RESERVATION OF SHELTER BEDS FROM THE MIAMI-DADE HOMELESS TRUST, FOR A PERIOD OF ONE (1) YEAR AND FOUR (4) MONTHS, AT AN AMOUNT NOT TO EXCEED $240,297.75; ALLOCATING FUNDS FROM THE PROJECTED FISCAL YEAR 2012-2013 BUDGET SURPLUS, SUBJECT TO SAID RESERVED SHELTER BEDS' EXCLUSIVE DESIGNATION FOR CITY OF MIAMI HOMELESS INDIVIDUALS AND THE AVAILABILITY OF FUNDS; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE MIAMI-DADE HOMELESS TRUST. WHEREAS, pursuant to Resolution No. 13-0216, adopted June 13, 2013, the City Commission allocated the amount of $240,297.75 for the purpose of purchasing and reserving fifteen (15) shelter beds for the use of City of Miami ("City") homeless individuals for a period of one (1) year and four (4) months, subject to the Miami -Dade Homeless Trust concomitant purchase and reservation of eighty-five (85) shelter beds for the exclusive use of City homeless individuals; and WHEREAS, on July 1, 2013, the Miami -Dade Homeless Trust Board met and resolved to fund an "approximate 98 beds ... plus the beds funded with City of Miami funds" provided that "100% of beds funded with the money from the City of Miami would be used only for City of Miami clients..."; and WHEREAS, the City desires to keep the same funding allocated by Resolution No. 13-0216 in place and to fund beds purchased and reserved for City homeless individuals in partnership with the Miami -Dade Homeless Trust; and WHEREAS, the purchase of beds shall be through the Miami -Dade Homeless Trust's transparent competitive procurement process which may yield more beds than originally anticipated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. Resolution No. 13-0216, adopted June 13, 2013, is rescinded in its entirety. Section 3. The purchase and reservation of shelter beds from the Miami -Dade Homeless Trust, for a period of one (1) year and four (4) months, at an amount not to exceed $240,297.75, is authorized, with funds allocated from the projected Fiscal Year 2012-2013 budget surplus, subject to said reserved shelter beds' exclusive designation for City homeless individuals, the availability of funds, and for beds at an available shelter at no cost to the homeless person within the territorial boundaries of the City of Miami or within one mile thereof, that treats homeless persons with dignity City of Miami Page 1 of 2 File Id: 13-00837 (Version: 21 Printed On: 9/6/2017 File Number: 13-00837 Enactment Number: R-13-0299 and respect, imposes no religious requirements, and does not impose involuntary substance abuse or mental health treatment. Section 4. The City Clerk is directed to transmit a copy of this Resolution to the Miami -Dade Homeless Trust. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
