HomeMy WebLinkAboutR-13-0297City of Miami Legislation Resolution: R-13-0297 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00833 Final Action Date: 7/25/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE TWO (2) CONSTRUCTION ACCESS AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED FORMS, WITH THE MIAMI-DADE COUNTY SCHOOL BOARD, FOR THE CONSTRUCTION OF THE OVERTOWN GREENWAY PROJECT, B-30624; CONVEYING TO THE CITY OF MIAMI ("CITY") A STRIP OF LAND ON THE SOUTHERN PORTION OF BOOKER T. WASHINGTON SENIOR HIGH SCHOOL ("HIGH SCHOOL") FOR RIGHT-OF-WAY PURPOSES AND AN EXISTING PORTION OF THE PARKING LOT OF THE HIGH SCHOOL FOR CONNECTIVITY TO NORTHWEST 7TH AVENUE, MIAMI, FLORIDA; GRANTING THE CITY THE RIGHT TO ACCESS A PORTION OF THE HIGH SCHOOL AND FREDERICK DOUGLASS ELEMENTARY SCHOOL, AS DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, WITH FULL RIGHT OF INGRESS THERETO AND EGRESS THEREFROM, FOR THE PURPOSE OF PERFORMING THE SCOPE OF WORK. WHEREAS, the City of Miami ("City") will be making certain hardscape and landscape improvements within the historical Overtown community, along Northwest 11th Terrace, between Northwest 2nd Avenue and Northwest 7th Avenue, Miami, Florida; and WHEREAS, as part of the Overtown Greenway Project, improvements will be constructed along Northwest 11th Terrace, adjacent to Booker T. Washington Senior High School ("High School"), located at 1200 Northwest 6th Avenue, and Frederick Douglass Elementary School, located at 314 Northwest 12th Street, Miami, Florida; and WHEREAS, to accomplish its work, the City has requested that a strip of land on the Southern portion of the High School be dedicated to the City for Right -of -Way purposes and an existing portion of the parking lot of the High School for connectivity to Northwest 7th Avenue, Miami, Florida; and WHEREAS, the Miami -Dade County School Board ("School Board") requires the execution of two (2) Construction Access Agreements, for said purposes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute two (2) Construction Access Agreements, in substantially the attached forms, with the School Board for the Project, for said purposes. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
