HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00806 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION APPROVING TWELVE (12) SCHOLARSHIPS TO ATTEND AN EDUCATIONAL INSTITUTION OR TO OBTAIN A COMMERCIAL DRIVERS LICENSE IN AN AMOUNT NOT TO EXCEED $3,000 PER SCHOLARSHIP, FOR THE FOLLOWING ELIGIBLE APPLICANTS: KIM FRASIER, MARCHAE GLENN, DIANA JULES, WENDY KELLY, NICHOLAS MARTIN, RONNIE MCDONALD, ERLAIN PETITFRERE, SCOTTY ROGERS, CAMILO ROJAS, SHERICA SMITH, HENDRICK TOUSSAINT AND TRENARIS TIMMONS; AUTHORIZING THE CITY MANAGER OR DESIGNEE TO DISBURSE THE SCHOLARSHIPS, UPON DISCRETION, WITH THE PRESENTATION OF SATISFACTORY DOCUMENTATION FROM THE EDUCATIONAL INSTITUTIONS OR VOCATIONAL PROGRAMS; FURTHER AUTHORIZING THE EXECUTION OF ALL DOCUMENTS NECESSARY FOR SAID PURPOSE, IN A FORM ACCEPTABLE TO CITY MANAGER OR DESIGNEE AND CITY ATTORNEY; ALLOCATING FUNDS FROM THE SPECIAL REVENUE FUND ENTITLED, "SOLID WASTE RECYCLING EDUCATIONAL TRUST FUND," ACCOUNT CODE NUMBER 13000.212000.534000.0000.00000. WHEREAS, pursuant to Ordinance No. 10654, adopted October 12, 1989, the City Commission established an educational trust fund as codified in Section 22-15 of the Code of the City of Miami, Florida, as amended ("City Code"), entitled "Educational trust fund established from recycling program for scholarships to children of certain city employees, conditions for implementation"; and WHEREAS, pursuant to this educational trust fund having been established from certain monies received by the City of Miami ("City") from the recycling program upon the accumulation of interest from the recycling program funds, as prescribed by Section 22-15 of the City Code, a scholarship award may be made for an amount that does not exceed $3,000 annually, to eligible, qualified employees of the City Department of Solid Waste ("Department"), or the children or legal -dependents of these employees, based upon a recommendation from the Director of Solid Waste, which is based on the applicable criteria in the ordinance or documents promulgated under it; and WHEREAS, pursuant to Ordinance No. 13330, adopted February 26, 2012, the City Commission approved and further amended Section 22-15 of the City Code to pay up to fifteen (15) scholarships to educational institutions for the employees of the Department to attend educational programs or for commercial driver's license certification; in addition to fifteen (15) scholarships to college level educational institutions for the children or legal dependents of the employees of the Department; for an award amount not to exceed $3,000 annually; and WHEREAS, Kim Frasier, Marchae Glenn, Diana Jules, Wendy Kelly, Nicholas Martin, Ronnie McDonald, Erlain Petitfrere, Scotty Rogers, Camilo Rojas, Sherica Smith, Hendrick Toussaint and Trenaris Timmons are recommended by the Director of Solid Waste, and by the Recycling Educational Scholarship Selection Committee, as eligible recipients of these scholarship funds; and WHEREAS, pursuant to Section 22-15 of the City Code, a total of thirty (30) scholarships may to City of -Miami Page 1 of 3 File Id: 13-00806 (Version: 1) Printed On: 7/3/2013 File Number: 13-00806 be awarded annually for an amount not to exceed $3,000 annually, for a maximum amount of $90,000; and WHEREAS, the Director of Solid Waste and the Recycling Educational Scholarship Selection Committee recommend the award of twelve (12) scholarships to eight (8) children or legal dependents of Solid Waste employees to attend a college level educational institution and four (4) to Solid Waste employees to attend an educational program or obtain commercial drivers license certification, for a total amount to exceed $30,000; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. Twelve (12) scholarships, for a total amount not to exceed $30,000, are approved, as the amount for the current Solid Waste Recycling Program Scholarship for the 2012-2013 Fiscal Year, for each of the following applicants: A. Kim Frasier, $1,500 B. Marchae Glenn, $3,000 C. Diana Jules, $3,000 D. Wendy Kelly, $3,000 E. Nicholas Martin, $3,000 F Ronnie McDonald, $1,500 G. Erlain Petitfrere, $1,500 H. Scotty Rogers, $1,500 I. Camilo Rojas, $3,000 J. Sherica Smith, $3,000 K. Hendrick Toussaint, $3,000 L. Trenaris Timmons, $3,000 Section 3. The recommendation of the Director of Solid Waste and the work of the Solid Waste Recycling Educational Selection Committee is acknowledged. Section 4. The City Manager or designee is authorized {1 } to disburse each of these twelve (12) scholarships, upon discretion, with the presentation of satisfactory documentation from the educational institution or vocational program. Section 5. The City Manager or designee is authorized {1} to execute all documents necessary for said purpose, in a form acceptable to the City Manager or designee, and the City Attorney. Section 6. Funds for said scholarships are to be allocated from Special Revenue Fund entitled "Solid Waste Recycling Educational Trust Fund", Account Code Number 13000.212000.534000.0000.00000. Section 7. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of the ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
