A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF
UNDERSTANDING ("MOU") AND A COST REIMBURSEMENT AGREEMENT FROM
THE FEDERAL BUREAU OF INVESTIGATION, IN SUBSTANTIALLY THE
ATTACHED FORM(S), FOR THE CITY OF MIAMI POLICE DEPARTMENT'S
CONTINUED PARTICIPATION IN IDENTIFYING AND TARGETING FOR
PROSECUTION CRIMINAL ENTERPRISE GROUPS RESPONSIBLE FOR DRUG
TRAFFICKING, MONEY LAUNDERING, ALIEN SMUGGLING, CRIMES OF
VIOLENCE SUCH AS MURDER AND AGGRAVATED ASSAULT, ROBBERY, AND
VIOLENT STREET GANGS, AS WELL AS TO INTENSELY FOCUS ON THE
APPREHENSION OF DANGEROUS FUGITIVES WHERE THERE IS OR MAY BE A
FEDERAL INVESTIGATIVE INTEREST; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE ANY OTHER DOCUMENTS NECESSARY, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO IMPLEMENT THE
ACCEPTANCE AND ADMINISTRATION OF SAID MOU AND COST
REIMBURSEMENT AGREEMENT.
WHEREAS, the City of Miami ("City") entered into a Memorandum of Understanding ("MOU") with
the Federal Bureau of Investigation ("FBI") in March, 2004 for the City Police Department's sworn
members' participation on the South Florida Gang and Criminal Organization Task Force; and
WHEREAS, the FBI has revised the MOU to include changes to the National Vehicle Lease
Program policy and added the new Department of Justice "Less -Than -Lethal" Devices Policy; and
WHEREAS, the execution of the MOU and the Cost Reimbursement Agreement will allow for
additional reimbursement funding to the City Police Department; and
WHEREAS, no matching funds are required from the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized {1} to execute a MOU and a Cost Reimbursement
Agreement from the FBI, in substantially the attached form(s), for the City Police Department's
continued participation in identifying and targeting for prosecution criminal enterprise groups
responsible for drug trafficking, money laundering, alien smuggling, crimes of violence such as
murder and aggravated assault, robbery, and violent street gangs, as well as to intensely focus on
the apprehension of dangerous fugitives where there is or may be a federal investigative interest.

Section 3. The City Manager is further authorized{1} to execute any other necessary documents,
in a form acceptable to the City Attorney, in order to implement the acceptance and administration of
said MOU and Cost Reimbursement Agreement.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
