AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE
BUILDING LINES/NONSTANDARD STREET WIDTHS", BY MODIFYING THE
WIDTH OF NORTHEAST 15TH STREET FROM NORTHEAST 2ND AVENUE TO
NORTH BAYSHORE DRIVE NORTHWEST/NORTHEAST 10TH STREET FROM
THE FLORIDA EAST COAST RAILWAY TO NORTHEAST 2ND AVENUE AND
NORTHWEST/NORTHEAST 11TH STREET FROM THE FLORIDA EAST COAST
RAILWAY TO NORTHEAST 1ST AVENUE, MIAMI, FLORIDA; CONTAINING A
SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Article V of Chapter 54 of the Code of the City of Miami, Florida, as amended ("City
Code"), establishes base building line locations for all public streets within the City of Miami ("City");
and
WHEREAS, Northeast 15th Street between Northeast 2nd Avenue and Biscayne Boulevard,
Miami, Florida, was originally dedicated as a 30 foot wide right of way identified as "Collins Bridge
Road" by the recording of the Amended Map of Nelson Villa Subdivision on March 23, 1917; and
WHEREAS, in 1941, the City acquired a series of deeds along the north side of Northeast 15th
Street for an additional 30 feet of right of way width, thereby, increasing the dedicated right of way
width to 60 feet and matching the alignment with Northeast 15th Street to the west of Northeast 2nd
Avenue, Miami, Florida; and
WHEREAS, the existing building located at 1500 Biscayne Boulevard, Miami, Florida, was
constructed in 1967 with a zero setback conforming to the current 60 foot dedicated right of way
width; and
WHEREAS, the OMNI complex, constructed in 1975, also conforms to the current 60 foot
dedicated right of way width; and
WHEREAS, in 1983, the City Code was amended to establish a zoned right of way width for
Northeast 15th Street between Northeast 2nd Avenue and North Bayshore Drive, Miami, Florida, as
80 feet, however, none of the reserved right of way width, 10 feet on both sides of the street, has
been dedicated; and
WHEREAS, the Miami -Dade County Metromover was constructed in 1991 along the south side of
Northeast 15th Street within the dedicated 60 foot right of way width, restricting the potential widening
of the street and the addition of traffic lanes; and
WHEREAS, Northwest/Northeast 10th Street from the Florida East Coast Railway to Northeast
2nd Avenue and Northwest/Northeast 11th Street from the Florida East Coast Railway to Northeast

1st Avenue, Miami, Florida, were originally dedicated as 50 foot wide roadways; and
WHEREAS, the zoned street width of this roadway was increased to a 75 foot wide roadway but
has not been dedicated or developed to the 75 foot width; and
WHEREAS, the Department of Public Works has evaluated the pedestrian and traffic operations,
utility and access needs in this area for present and potential future development and determined that
a reduction in the zoned street width of Northeast 15th Street from Northeast 2nd Avenue to North
Bayshore Drive, Miami, Florida, from 80 feet to 60 feet, and Northwest/Northeast 10th Street from the
Florida East Coast Railway to Northeast 2nd Avenue from 75 feet to 50 feet and Northwest/Northeast
11 th Street from the Florida East Coast Railway to Northeast 1st Avenue, Miami, Florida, from 75 feet
to 50 feet, will have no substantial impact on these services;
WHEREAS, the Departments of Police, Fire -Rescue and Solid Waste have evaluated the effect of
the reduction of the zoned street width of these roadways on their operations and have no substantial
objections;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. Chapter 54/Article V/Section 54-190 of the City Code, entitled "Streets and
Sidewalks/Base Building Lines/Nonstandard Street Widths", is amended in the following
particulars: {1}

Section 3. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective 30 days after final reading and adoption
thereof. {2}

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within
ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the City Commission.
