HomeMy WebLinkAboutLegislation FRCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00587 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE II/ SECTION 54-56 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/CONSTRUCTION, EXCAVATION AND REPAIR/ CONSTRUCTION, RECONSTRUCTION OR REPAIR OF STREET IMPROVEMENTS REQUIRED WHEN ADJACENT PROPERTY IS IMPROVED BY CONSTRUCTION OF $100,00 OR MORE IN VALUE OR EXCEEDING 1,000 SQUARE FEET IN FLOOR AREA; RESTRICTION"; BY REMOVING THE REQUIREMENT OF CONSTRUCTING OR RECONSTRUCTING STREETS AND SIDEWALKS WHEN A BUILDING OR PARKING FACILITY IS BEING REMODELED, RENOVATED AND REPAIRED; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 54, Article II, Section 54-56 of the Code of the City of Miami, Florida, as amended ("City Code"), requires the property owner to construct, reconstruct or repair street improvements, including sidewalks, curbs or gutters, pavement, modifications to the existing drainage systems and sodding, when any adjacent property is improved, altered or modified by the construction, reconstruction, remodeling, renovation or repair of any type of building, structure or parking area amounting to $100,000 or more in total value, or 1,000 square feet or more in floor area, for which a permit is required; and WHEREAS, certain private property improvements, namely remodeling, renovations and repairs to existing buildings, structures and parking facilities, although exceeding the minimum required threshold, are not reasonably and substantially related to the construction, reconstruction or repair of street improvements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as fully set forth in this Section. Section 2. Chapter 54/ Article II/Section 54-56 of the City Code entitled "Streets and Sidewalks/Construction, Excavation and Repair/ Construction, reconstruction or repair of street improvements required when adjacent property is improved by construction of $100,000.00 or more in value or exceeding 1,000 square feet in floor area; restriction", is amended in the following particulars: {1} "CHAPTER 54 STREETS AND SIDEWALKS City of Miami Page 1 of 2 File Id: 13-00587 (Version: 1) Printed On; 5/24/2013 File Number: 13-00587 ARTICLE II. CONSTRUCTION, EXCAVATION AND REPAIR Sec. 54-56. Construction, reconstruction or repair of street improvements required when adjacent property is improved by construction of $100,000.00 or more in value or exceeding 1,000 square feet in floor area; restriction. (a) Sidewalks, Curbs and/or gutters, pavement, modifications to existing drainage systems and sodding (hereinafter "street improvements") shall be constructed, reconstructed or repaired when any adjacent property located within the corporate limits is improved, altered or modified by the construction, reconstruction, remodeling, renovation or repair addition of any type of building, structure or parking facility amounting to $100,000.00 or more in total value, or when such building, structure or parking facility to be constructed, reconstructed, remodeled, renovated or repaired when there is an addition which is 1,000 square feet or more in floor area, for which a permit is required. Section 3. If any section, part of a section, paragraph, clause, phrase or word of the Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor. {2) APPROVED AS TO FORM AND CORRECTNESS CITY ATTORNEY Footnotes: {1} Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission.
