HomeMy WebLinkAboutR-13-0261City of Miami Legislation Resolution: R-13-0261 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00746 Final Action Date: 6/27/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION DESIGNATING THE CITY OF MIAMI'S ("CITY") CODE ENFORCEMENT SPECIAL MASTERS TO SERVE AS LOCAL HEARING OFFICERS PURSUANT TO CHAPTER 2013-160, LAWS OF FLORIDAAND FURTHER DESIGNATING THE OFFICE OF HEARING BOARDS WITHIN THE PLANNING AND ZONING DEPARTMENT AND ITS STAFF TO SERVE AS THE CLERK TO THE CITY'S LOCAL HEARING OFFICERS PURSUANT TO CHAPTER 2013-160, LAWS OF FLORIDA TO CONTINUE CARRYING OUT THE CITY'S TRAFFIC INFRACTION DETECTOR PROGRAM. WHEREAS, the Florida Legislature passed the CS/CS/HB 7125 ("HB 7125") during the 2013 Legislative Session, providing for local hearings related to notices of violations connected with the use of traffic infraction detectors to enforce Chapter 316, the State of Florida Uniform Traffic Code; and WHEREAS, the Governor of the State of Florida signed HB 7125 into law on June 12, 2013, resulting in the Chapter 2013-160, Laws of Florida taking effect on July 1, 2013; and WHEREAS, the City of Miami ("City") wishes to utilize existing resources, staff, and special masters to implement the provisions of Chapter 2013-160, Laws of Florida; NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Effective July 1, 2013, the City's Code Enforcement Special Masters are hereby designated to serve as Local Hearing Officers, as set forth in Section 4 of Chapter 2013-160, Laws of Florida. Section 3. Effective July 1, 2013, the Office of Hearing Boards within the Planning and Zoning Department and its existing staff is designated to serve as the Clerk to the City's Local Hearing Officers pursuant to Section 5 of Chapter 2013-160, Laws of Florida. Section 4.
