The Owner respectfully requests that the City Commission's favorably consider their request to modify a Declaration of Restrictive Covenants (the "Declaration") currently recorded against the Property and, as such, tenders this letter of intent in support of its Special Appearance application along with the required application materials, The Property is roughly bounded by Briekeli Avenue to the east, S.E. 256 Road to the north, S, Miami Avenue to the west, and by the Rickenbacker Causeway overpass to the south. Currently, the Property is improved by a 69-room hotel facing Brickell Avenue with the accompanying surface parking lot access from South Miami Avenue. 'a rfifiPlf6l3er t9rOlso encompasses a parcel of land located at 2501 South Miami Avenue. {26268599;1 } April 30, 2013 Page 2 In 2002, the then owners of the Property recorded the Declaration in favor of the City of Miami (the "City") and three (3) neighborhood associations: (i) the 13rickell Homeowners Association, Inc.; (ii) the Roads Homeowners Association, Inc„ and (iii.) the South Miami Avenue Homeowners Association, Inc. (collectively, the "Neighborhood Associations"), A copy of the Declaration is attached hereto as Exhibit "A". The Declaration imposed certain (imitations on the future development of the Property generally consisting of: ■ A limitation on the height of any structure to a maximum of five (5) stories, with each story not to exceed twelve (12) feet in height; and ■ A requirement that development occur in substantial accordance with the plans prepared by Palenzuela & Hevia Design Group, dated June 30, 1999 (the "Approved Plans"). When the current Owner of the Property acquired the Property in 2007, in accordance with the guidelines set forth in the 2002 covenant they obtained permits from the City, including a Class 11 Permit, and undertook a renovation of the entire property. The renovations did not contemplate any additional building area, instead it upgraded the interior and exterior of the existing building and improvements to the parking lot. Rather than construct the improvements identified in the Approved Plans, the Owners now desire to construct a 64-room addition -to the hotel located at the rear of the existing structure. The proposed addition generally consists of a 5-story building (approximately 49' in height) that complements the architecture of the existing building, as well as a 2,000 square foot restaurant and some pre -function/ meeting room space (collectively, the "Proposed Plans"). A copy of the proposed modification to the Declaration is attached hereto as Exhibit "13". We believe the Proposed Plans have many positive attributes that will serve to enhance both the Property and quality of life in the surrounding area. In particular, the proposed site plan: ■ Consists of an elegantly designed addition that is set- back from South Miami Avenue well in excess of the requirements set forth in Miami 21 in order to avoid any commercial intrusion into the surrounding residential neighborhoods; ■ Removes existing surface parking spaces located close to South Miami Avenue and S.E, 25t'' Road and places them further away from the property lines behind an enhanced landscaped buffer that serves to obscure the on -grade parking from S. Miami Avenue, S.E. 25th Road, and at the intersection of these two roads; ■ Relocates much of the existing surface parking below grade, reducing the current number of on -grade spaces from the current total of 53 spaces to only 19 spaces; and ■ Eliminates one (1) vehicular driveway into the Property on S. Miami Avenue and replaces it with greater landscaping both on the Property and within the right-of-way which both serves to screen the on -grade spaces and further reduce the potential for vehicular and pedestrian conflicts. {26268599,1} April 30, 2013 Page 3 Consistent with the requirements set forth in Section (5) of the Declaration, the Owner has notified all of the Neighborhood Associations.
