HomeMy WebLinkAboutR-13-0242City of Miami Legislation Resolution: R-13-0242 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00642 Final Action Date: 6/27/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT SEVEN TO THE FISCAL YEAR 2005 COMMUNITY DEVELOPMENT BLOCK GRANT DISASTER RELIEF INITIATIVE ROUND I CONTRACT BETWEEN MIAMI-DADE COUNTY AND THE CITY OF MIAMI, IN SUBSTANTIALLY THE ATTACHED FORM, EXTENDING THE CONTRACT FROM JULY 31, 2012 TO JUNE 30, 2013, FOR THE PURPOSE OF OBTAINING ADDITIONAL TIME TO COMPLETE THE REHABILITATION OF THE PROJECTS THAT SUFFERED HURRICANE DAMAGE; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY FUTURE AMENDMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NEEDED. WHEREAS, pursuant to Resolution No. 07-0131, adopted March 8, 2007, the Miami City Commission authorized the City Manager to accept a Community Development Block Grant ("CDBG") grant award in the amount of $2,000,000 from Miami -Dade County ("County"), for the City of Miami's ("City") Disaster Recovery Program; and WHEREAS, said funds were to be utilized to provide rehabilitation assistance to multi -family properties that were damaged due to Hurricane Katrina; and WHEREAS, on September 11, 2007, the Fiscal Year ("FY") 2005 CDBG Disaster Relief Initiative ("DRI") contract between the City and the County was executed for the purpose of providing CDBG funds for the rehabilitation of multi -family properties with an expiration date of June 30, 2008; and WHEREAS, pursuant to Resolution Nos. 09-0216, 10-0086, 10-0537, 12-0165, 12-0254, adopted May 14, 2009, February 25, 2010, December 16, 2010, April 12, 2012 and July 12, 2012, respectively, the Miami City Commission authorized various amendments extending the contract date of the FY 2005 CDBG DRI contract; and WHEREAS, the County has provided an extension to the FY 2005 CDBG DRI contract to June 30, 2013 for the purpose of obtaining additional time to complete all funded projects; and WHEREAS, to date 248 units of housing have been assisted through the City's Disaster Recovery Program; and WHEREAS, the City Administration recommends the approval of an extension to the FY 2005 CDBG DRI contract between the County and the City for the City's Disaster Recovery Program from July 31, 2012 to June 30, 2013, for the rehabilitation of the projects, further authorizing the City Manager to execute Amendment Seven to the FY 2005 CDBG DRI contract for the extension of the contract, in substantially the attached form; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File Id: 13-00642 (Version: 11 Printed On: 9/1/2017 File Number: 13-00642 Enactment Number: R-13-0242 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute Amendment Seven to the FY 2005 CDBG DRI Round I contract between the County and the City, in substantially the attached from, extending the contract from July 31, 2012 to June 30, 2013, for the purpose of obtaining additional time to complete the rehabilitation of the projects that suffered hurricane damage. Section 3. The City Manager is further authorized{1} to execute any future amendments, in a form acceptable to the City Attorney, as may be needed. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
