& 830 SOUTHWEST 11TH AVENUE, MIAMI, FLORIDA; FURTHER IDENTIFIED
IN EXHIBIT "A", ATTACHED AND INCORPORATED; FURTHER, THE
PLANNING AND ZONING DEPARTMENT HAVING CONDUCTED A BIENNIAL
EVALUATION OF THE MIAMI 21 ATLAS OF THE ZONING ORDINANCE,
PURSUANT TO SECTION 7.1.2.8.B.2, HAS FOUND THE CHANGES TO BE
APPROPRIATE AND CONSISTENT WITH THE DEVELOPMENT DIRECTION
OF THE CITY OF MIAMI'S NEIGHBORHOODS, RESULTING ZONING
CHANGES APPROVED THROUGH THIS BIENNIAL EVALUATION OF THE
MIAMI 21 ATLAS, PURSUANT TO SECTION 7.1.2.8.B.2, SHALL NOT
PROHIBIT, PREVENT OR LIMIT OWNERS OF AFFECTED PROPERTIES
IDENTIFIED HEREIN FROM APPLYING FOR A REZONING PURSUANT TO
SECTION 7.1.2.8.G.5; FURTHER DIRECTING THE PLANNING AND ZONING
DEPARTMENT TO REVERT ANY ACCOMPANYING FUTURE LAND USE
CHANGE ADOPTED FOR ANY ZONING CHANGE NOT APPROVED IN THIS
ORDINANCE IN ORDER TO MAINTAIN CONSISTENCY BETWEEN THE
ZONING ATLAS OF ORDINANCE NO. 13114 AND THE MIAMI
COMPREHENSIVE NEIGHBORHOOD PLAN, FUTURE LAND USE MAP;
MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE AND
PROVIDING FOR AN EFFECTIVE DATE.
Approximately 828 SW 8th Avenue, 829 & 830 SW 8th Court, 814 & 829 SW 9th
Avenue, 824 & 831 SW 9th Court, 826 & 827 SW 10th Avenue, and 827 & 830
SW 11th Avenue [Commissioner Frank Carollo - District 3]

This will change the above properties to "T4-L" as part of the Biennial Evaluation
of the Miami 21 Atlas.

ANALYSIS FOR ZONING CHANGE
Approximately 828 SW 8th Avenue, 829 & 830 SW 8th Court, 814
& 829 SW 9th Avenue, 824 & 831 SW 9th Court, 826 & 827 SW 10th Avenue,
and 827 & 830 SW 11th Avenue

Article 7, Section 7.1.2.8.b.(2) of Ordinance 13114, the Zoning Ordinance of the City of Miami states that, the City
may conduct a comprehensive review of the Miami 21 Atlas every two years to evaluate the development direction of
the City's neighborhoods and determine if additional amendments are appropriate.
The Planning and Zoning Department having conducted said biennial review, has found the following changes to be
appropriate and consistent with the development direction of the city's neighborhoods.

The subject properties are located within the Little Havana NET area, and consist of eleven (11) selected parcels
comprising of approximately 1.31± acres of land, as depicted in Exhibit "A" (A complete legal description is on file at
the Hearing Boards Office)
Review and analysis of the proposed changes finds that:
• In this area, SW 8th Street is a significant high pedestrian and vehicular traffic city corridor designated with
T6-8-0 Transect zone, with limited parking offer in certain stretches.
• The parking requirements for the uses in place on the North side of SW 8th Street in the stretch confined by
8th Avenue to the East and 12th Ave to the West has been mitigated by parking areas on the North's side of
said stretch, where the zoning designation T5-L allows for that purpose.
• The same mitigation does not occur to the South, where the zoning designation is T4-R and parking
supporting commercial properties is not allowed.

• The selected properties and the proposed zoning change to T4-L comes out from an analysis conducted by
the Planning and Zoning Department based on the following criteria:
o Provide SW 8th Street corridor with the possibility to allocate/mitigate parking to the south in the
same way it occurs to the north.
o Maintain the existing transition in density and intensity to the South.
o The proposed changes do not affect the existing residential character of the properties fronting SW
9th Street.
• This change will require an amendment to the Future Land Use Map of the Miami Comprehensive
Neighborhood Plan for the subject properties from "Duplex Residential" to "Low Density Restricted
Commercial".
• The selected properties are the first platted lot immediately south to the T6-8-0 commercial Tots facing SW
8th Street corridor, oriented in an east -west manner and fronting the avenues and courts that are
perpendicular to SW 8th Street as shown in Exhibit "A".
Based on these findings, the Planning and Zoning Department is recommending approval of the
application as presented.

Analysis for ZONING CHANGE

a) The proposed change conforms with the adopted Miami Comprehensive
Neighborhood Plan and does not require a plan amendment.
b) The proposed change is in harmony with the established land use pattern.
c) The proposed change is related to adjacent and nearby districts.
d) The change suggested is not out of scale with the needs of the neighborhood
or the city.
e) The proposed change maintains the same or similar population density
pattern and thereby does not increase or overtax the Toad on public facilities
such as schools, utilities, streets, etc.
f) Existing district boundaries are illogically drawn in relation to existing
conditions on the property proposed for change.
g) Changed or changing conditions make the passage of the proposed change
necessary.
h) The proposed change positively influences living conditions in the
neighborhood.
i) The proposed change has the same or similar impact on traffic and does not
affect public safety to a greater extent than the existing classification.
j) The proposed change has the same or similar impact on drainage as the
existing classification.
k) The proposed change has the same or similar impact on light and air to
adjacent areas as the existing classification.
I) The proposed change has the same or similar impact on property values in the
adjacent area as the existing classification.
m) The proposed change will contribute to the improvement or development of
adjacent property in accord with existing regulations.
n) The proposed change conveys the same treatment to the individual owner as
to owners within the same classification and the immediate area and furthers the
protection of the public welfare.
o) There are substantial reasons why the use of the property is unfairly limited
under existing zoning.
p) It is difficult to find other adequate sites in the surrounding area for the
proposed use in districts already permitting such use.
