CERTIFICATION AND DECLARATION Of ELECTION RESULTS FOR THE WYNWOOD BUSINESS IMPROVEMENT DISTRICT ELECTION STATE OF FLORIDA COUNTY OF MIAMI-DADE CITY OF MIAMI I, TODD B. HANNON, City Clerk of the City of Miami, Florida, do hereby certify that the necessary steps were taken pursuant to City of Miami Resolution R-13-0136 in connection with the conduct of the mail ballot election of the Wynwood Business Improvement District Election conducted during the period of April 29, 2013 through June 4, 2013, and a walk-in election conducted on June 4, 2013. The walk-in election was conducted from 8:00 A.M. until 5:00 P.M. at the Wynwood Walls, located at approximately 2520 NW 2nd Avenue in the City of Miami. I. On April 11, 2013, the City of Miami Commission via Resolution R-13-0136 established a special assessment district area to be known as the Wynwood Business Improvement District (BID) and authorized the levy and collection of a special assessment for a period of ten (10) years subject to the approval of a majority of affected property owners of the BID area established by Resolution R-13-0136, and pursuant to an election to be duly conducted by the City Clerk. Ir. The Office of the City Clerk conducted an election comprised of a mail ballot election from April 29, 2013 through May 31, 2013 and a walk-in election conducted on June 4, 2013, and further duly published notice of said election the week of May 14, 2013, the week of May 24, 2013 and on Sunday June 2, 2013 in newspapers and magazines of general circulation for the BID area. In. On April 24, 2013, the City Clerk sent ballots via certified rnail to the owners of the 418 affected properties listed on the Preliminary Assessment Roll attached to Resolution R- 13-0136. iv. A total of 217 ballots were cast by mail or hand delivered on or before May 31, 2013, and eighty-five (85) ballots were cast in -person on June 4, 2013, resulting in an overall total of 302 ballots cast. Of the 302 ballots cast, 274 ballots were cast as a YES vote, and 28 ballots were cast as a NO vote. VI. Of the 418 properties, 116 ballots were either undeliverable, not submitted, or were submitted but deemed invalid because of improperly executed affidavits or missing signatures, and are thus considered to be NON -votes which are NO Votes. VIl. I further certify and declare that the results of the Wynwood Business Improvement District Election ending at 5:00 PM, June 4, 2013 are as follows: YES NO TOTAL Ballots Cast 274 28 302 Non -Votes 0 116 116 Total 274 144 418 v]I. Therefore, I certify that the Wynwood Business Improvement District was approved by a majority of affected property owners of the BID area.
