HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00492 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE EMERGENCY UTILITIES PILOT PROGRAM, AS SPECIFIED IN EXHIBIT "A", ATTACHED AND INCORPORATED; AUTHORIZING THE ALLOCATION OF COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG") FUNDS IN THE AMOUNT OF $5,000, FROM THE DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT DISTRICT 3 CDBG RESERVE ACCOUNT TO PROVIDE EMERGENCY UTILITY ASSISTANCE TO QUALIFIED RESIDENTS; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, due to the current financial crisis, the District 3 community has seen a rise in utility defaults resulting in the disconnection of utilities; and WHEREAS, the goal of the Emergency Utilities Pilot Program is to provide residents with emergency assistance with past due utility bills to ensure the safety of residents; and WHEREAS, a summary of the Emergency Utilities Pilot Program Policies and Guidelines is attached and incorporated as Exhibit "A"; and WHEREAS, the City Administration recommends approving said Emergency Utilities Pilot Program Policies and Guidelines; and WHEREAS, the City Administration further recommends approving the allocation of CDBG funds in the amount of $5,000 from the Department of Community and Economic Development District 3 CDBG Reserve Account for the Emergency Utilities Pilot Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Emergency Utilities Pilot Program, as specified in Exhibit "A", attached and incorporated, is approved. Section 3. The allocation of CDBG funds, in the amount of $5,000 from the Department of Community and Economic Development District 3 CDBG Reserve Account to provide emergency utility assistance to qualified residents, is authorized. Section 4. The City Manager is authorized {1} to execute all necessary documents, in a form acceptable to the City Attorney, for said purpose. BRU CITY-AT-TOR-NEY- Footnotes: {1} The herein authorization is further subject to compliance wiithall scebuirements that by applicable may be imposed by the City Attorney, including but not limited to pra Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
