HomeMy WebLinkAboutR-13-0212City of Miami Legislation Resolution: R-13-0212 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00582 Final Action Date: 6/13/2013 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING ("MOU"), A COST REIMBURSEMENT AGREEMENT, AND A VEHICLE USE AGREEMENT (COLLECTIVELY "AGREEMENTS"), IN SUBSTANTIALLY THE ATTACHED FORMS, WITH THE FEDERAL BUREAU OF INVESTIGATION, FOR THE DEPARTMENT OF POLICE'S PARTICIPATION IN THE SOUTH FLORIDA CYBER TASK FORCE; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO IMPLEMENT THE ADMINISTRATION OF SAID MOU AND AGREEMENTS. WHEREAS, the Federal Bureau of Investigation ("FBI") has requested the City of Miami's ("City's") Department of Police to enter into a Memorandum of Understanding ("MOU"), a Cost Reimbursement Agreement and a Vehicle Use Agreement (collectively "Agreements") in support of coordinating intelligence, investigative, and operational responses to cyber threats, and attacks; and WHEREAS, under said MOU, City police officers will be deputized by the FBI and could be deployed to travel outside of the United States; and WHEREAS, the FBI will assume the costs for travel in accordance with the Federal Travel Regulations to conduct investigations outside the field office territory; and WHEREAS, subject to funding availability and legislative authorization, the FBI may reimburse to the participating agency the cost of overtime worked by non-federal Cyber Task Force ("CTF") members assigned full-time to CTF, provided overtime expenses were incurred as a result of CTF related duties; and WHEREAS, a separate Cost Reimbursement Agreement must be executed between the FBI and the participating agency, consistent with regulations and policy; and WHEREAS, subject to funding availability and legislative authorization, the FBI may provide a lease vehicle, fuel purchase card, and smart phone to non-federal full-time CTF personnel for use in carrying out CTF related duties; and WHEREAS, a Vehicle Use Agreement must be executed between the FBI and the participating agency before being issued these items; and WHEREAS, no matching funds are required from the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File Id: 13-00582 (Version: 1) Printed On: 8/31/2017 File Number: 13-00582 Enactment Number: R-13-0212 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute a MOU and Agreements, in substantially the attached forms, with the FBI, for the City's Department of Police's participation in the South Florida Cyber Task Force. Section 3. The City Manager is further authorized {1} to execute any other necessary documents, in a form acceptable to the City Attorney, in order to implement the administration of said MOU and Agreements. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1 } The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
