Direclt6 Chief %/-� City Manager, Page 1 of 2 Subject: Agreement with Miami -Dade County for water and sewer services on the City -owned property located at 1099 MacArthur Causeway The City -owned property located at 1099 MacArthur Causeway ("Property"), currently occupied by the Miami Outboard Club ("Lessee"), is in need of water and sewer work. The attached Agreement with Miami -Dade County enumerates the terms and conditions. As per the Agreement, the City will be providing the County with easements and the City will be responsible for proper permitting of the improvements that will vest with the County. Pursuant to the terms of the Lease Agreement with the Lessee, the Lessee is responsible for all costs related to the installation of any lines and equipment necessary on the Property. Therefore, in anticipation of such improvements being made to the Property, the City and the Lessee have executed Amendment No. 4 to the Lease Agreement between the City of Miami and the Miami Outboard Club, Inc. ("Fourth Amendment"), a draft which is attached to this agenda item, in which the Lessee has remitted a $60,000 payment to the City ("WASA Deposit"). The City is holding the WASA Deposit in a non -interest bearing escrow account. The City shall use the WASA Deposit to pay WASA for the project in the event the Lessee does not remit direct payment to WASA for the for the expenses, including but not limited to, connection charges, the cost of designing, building and installing the necessary water and sewer facilities, the Opinion of Titles, and County service charges associated with the City's Agreement with WASA. The Administration recommends that the City Commission enter into the Agreement with Miami -Dade County for the proposed water and sewer work necessary at the Property with terms and conditions more particularly set forth in the Agreement.
