HomeMy WebLinkAboutLocal Office Definitions - Municipal Comparisons FR/SRLocal Office Definitions: Municipal Comparisons Broward County Local business means the vendor has a valid occupational license issued by Broward County at least one year prior to bid or proposal opening to do business in Broward County that authorizes the business to provide the goods, services or construction to be purchased and a physical business address located within the limits of Broward County, in an area zoned for the conduct of such business, from which the vendor operates or performs business on a day-to-day basis that is a substantial component of the goods or services being offered to Broward County. Post Office Boxes are not verifiable and shall not be used for the purpose of establishing said physical address. In order to be eligible for local preference, the vendor must provide a copy of the occupational license(s) for the covered period prior to recommendation for award. Miami -Dade County Local business means the vendor has a valid business tax receipt issued by Miami -Dade County at least one year prior to bid or proposal submission, and a physical business address located within the limits of Miami -Dade County from which the vendor operates or performs business. Firms who provide goods or services which are exempt from Miami -Dade Business Tax Receipt requirements shall be required to submit documentation, to the County's satisfaction, demonstrating the physical business presence of the firm within the limits of Miami -Dade County for at least one year prior to bid or proposal submission. Post Office Boxes are not verifiable and shall not be used for the purpose of establishing said physical address. In addition to the foregoing, a vendor shall not be considered a "local business" unless it contributes to the economic development and well-being of Miami -Dade County in a verifiable and measurable way. This may include, but not be limited to, the retention and expansion of employment opportunities and the support and increase to the County's tax base. Vendors shall affirm in writing their compliance with the foregoing at the time of submitting their bid or proposal to be eligible for consideration as a "local business" under this section. A vendor who misrepresents the status of its firm under this Section in a proposal or bid submitted to the County will lose the privilege to claim any preference under this Section for a period of up to one year. The County Mayor, in his discretion, may also recommend that the firm be referred for debarment in accordance with'Section 2-8.4.1 of the Code of Miami -Dade County. Locally Headquartered Business means a Local Business as defined in this Section which has a Principal Place of Business in Miami -Dade County. Principal Place of Business means the nerve center or the center of overall direction, control, and coordination of the activities of the bidder. If the bidder has only one business location, such business location shall be its principal place of business. Palm Beach County "Local business" means a bidder or proposer which has a permanent place of business within the county and which holds a business tax receipt issued by the county that authorizes the bidder or proposer to provide the goods, services, or construction to be purchased and which is issued prior to the issuance of the invitation for bids/request for proposals for which a preference is sought. If the business is a joint venture/partnership, it is sufficient for qualification as a local business if at least one (1) of the joint ventures/partners meets the test set forth in this subsection. "Non -local business" means a bidder or proposer which is not a local business. "Permanent place of business" means headquarters which are located within the county or within the Glades for Glades businesses, or a permanent office or other site located within Palm Beach County or within the Glades for Glades businesses, from which a bidder or proposer will produce a substantial portion of the goods or perform a substantial portion of the services to be purchased and which was in existence prior to the issuance of the invitation for bids/request for proposals. A post office box or location at a postal service center shall not constitute a permanent place of business. City of North Miami Business location means a permanent office or other site where the local business conducts, engages in, or carries on all or a portion of its business. A post office box or a location at a postal service center shall not constitute a business location. Local business means the offeror, supplier, or contractor: (1) has a business located in the city with a current city business tax receipt issued prior to the city's issuance of the solicitation for supplies or services;(2) has at least ten (10) percent of its total workforce residing in the city prior to the city's issuance of the solicitation for supplies or services; and/or (3) subcontracts at least ten (10) percent of the contractual amount of a city project with subcontractors who are physically located within the city. The offeror, supplier, or contractor seeking the local business preference has the burden to show that it qualifies for the preference, to the satisfaction of the city. City of Pembroke Pines LOCAL BROWARD COUNTY VENDOR. A business entity which has maintained a permanent place of business with full-time employees within the Broward County limits for a minimum of one year prior to the date of issuance of a bid or proposal solicitation. The permanent place of business may not be a post office box. The business location must actually distribute goods or services from that location. In addition, the business must have a current business tax receipt from the Broward County or the city within Broward County where the business resides. LOCAL PEMBROKE PINES VENDOR. A business entity which has maintained a permanent place of business with full-time employees within the city limits for a minimum of one year prior to the date of issuance of a bid or proposal solicitation. The permanent place of business may not be a post office box. The business location must actually distribute goods or services from that location. In addition, the business must have a current business tax receipt from the City of Pembroke Pines. City of Vero Beach Local business shall mean a business that meets all of the following criteria: (1) Has had a staffed and fixed office or distribution point, with a verifiable street address, located within Indian River, Martin, or St. Lucie Counties for at least one full calendar year immediately prior to the issuance of the request for competitive bids or request for proposals by the city. Post office boxes shall not be used or considered for the purpose of establishing a physical address; and (2) Has had, for at least 12 months immediately prior to the date of the advertisement for the particular good or service being solicited, a current "local business tax receipt" issued by the City of Vero Beach, Indian River, Martin, or St. Lucie Counties, if applicable; and (3) Holds any license or competency card required by Indian River County, if applicable, and; (4) If the contract is awarded, will be the person or entity in direct privity of contract with the City of Vero Beach and not as subcontractor, or any lower -tier subcontractor, material man, or supplier. Non -local business means a bidder that is not a local business, as defined herein. Certification. Any person or entity claiming to be a local business, as defined herein, and desiring to receive local preference, shall complete and submit, together with all required attachments, a "local business certification form," in the form provided by the city and contained within the bid package accompanying a public notice/advertisement. Any bidder who fails to complete and submit the "local business certification form" together with all required attachments with the bid shall not be granted local preference consideration for the purposes of that specific contract award. The purchasing division shall determine if a person or entity meets the definition of a "local business."
