Subject: Third Addendum to Lease Airspace Agreement with the Florida Department of Transportation
providing the City with authorization to install security cameras on a portion of the FDOT-owned property
identified as RWMS 1059 and RWMS 1060
Purpose of Item:
A Resolution of the City of Miami Commission, with attachments, authorizing the City Manager to execute the
Third Addendum to the Airspace Agreement ("Third Addendum"), in substantially the attached form,
between the City of Miami ("City") and the Florida Department of Transportation ("FDOT"), allowing the City
to install security cameras on a portion of the FDOT-owned property identified as Right -of -Way Parcel
("RWMS") 1059 and 1060, further authorizing the City Manager, subject to consultation with the Department
of Police, to negotiate and to execute any future amendments, extensions, and/or supplements to the form of
the agreement, subject to the approval of legal form and correctness by the City Attorney and subject to
budgetary approval at the time of need; and, with additional terms and conditions more particularly set forth
in said Third Addendum.

Subject: Third Addendum to Lease Airspace Agreement with the Florida Department of Transportation
providing the City with authorization to install security cameras on a portion of the FDOT-owned property
identified as RWMS 1059 and RWMS 1060
The State of Florida Department of Transportation ("FDOT") is the owner of right -of way parcels ("RWMS")
located under 1-95 between Northwest 4th Street to Northwest 8th Street.
On February 24, 2005, the City Commission adopted Resolution 05-0112 authorizing the City Manager to
execute an Airspace Agreement ("Agreement") and Addendum to Airspace Agreement ("First Addendum")
with FDOT to lease and utilize an RWMS parcel identified as parcel 1059 under 1-95 between Northwest 4th to
Northwest 7th Streets, Miami, Florida, for the public purpose and use as parking for police and impound
vehicles for a five (5) year period, until June 19, 2010, with an annual rent of $1.00.
On December 17, 2009, the city Commission adopted Resolution 09-0579 authorizing the City manager to
execute a Second Addendum to Airspace Agreement ("Second Addendum") with FDOT to add the use of
RWMS Parcel 1060, which is located under 1-95 between Northwest 7th Street and Northwest 8th Streets,
providing for a term of five (5) years, with three (3) additional five (5) year terms for RWMS 1059 and 1060 for
no rent, for use by the City of Miami Police Department to accommodate overflow parking, the parking of
specialized operational police vehicles, storage of police evidence and for allied or related and incidental
public purposes, subject to FDOT's approval of any improvements.
Sometime in 2010, the Police department installed security cameras in an area within RWMS 1059 and RWMS
1060, more specifically between Northwest 5th Street and Northwest 7th Street. These improvements, as
stipulated by the Agreement, must be approved by FDOT; therefore, the City and FDOT wish to enter into this
Third Addendum to the Agreement ("Third Addendum") in which FDOT provides the City with the
authorization to install security cameras, as well as the specifications as particularly set forth in said Third
Addendum.
