HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 13-00333 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE THE THIRD ADDENDUM TO THE AIRSPACE AGREEMENT ("THIRD ADDENDUM"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), ALLOWING THE CITY TO INSTALL SECURITY CAMERAS ON A PORTION OF THE FDOT-OWNED PROPERTY IDENTIFIED AS RIGHT-OF-WAY PARCEL ("RWMS") 1059 AND RWMS 1060; FURTHER AUTHORIZING THE CITY MANAGER, SUBJECT TO CONSULTATION WITH THE DEPARTMENT OF POLICE, TO NEGOTIATE AND TO EXECUTE ANY FUTURE AMENDMENTS, EXTENSIONS, OR SUPPLEMENTS TO THE FORM OF THE AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND SUBJECT TO BUDGETARYAPPROVALAT THE TIME OF NEED, WITH ADDITIONAL TERMS AND CONDITIONS MORE PARTICULARLY SET FORTH IN SAID THIRD ADDENDUM. WHEREAS, the Florida Department of Transportation ("FDOT") is the owner of certain real property located under 1-95 between Northwest 4th Street and Northwest 8th Street, Miami, Florida ("Property"), also known as Right -of -Way Parcel ("RWMS") 1059 and RWMS 1060; and WHEREAS, the City of Miami ("City") leases the Property from FDOT; and WHEREAS, the City Police Department ("Department") uses the Property to accommodate overflow parking, the parking of specialized operational police vehicles, storage of police evidence and forallied or related and incidental public purposes, subject to FDOT's approval of any improvements; and WHEREAS, the Department installed security cameras in an area within the Property, specifically between Northwest 5th Street and Northwest 7th Street, Miami, Florida; and WHEREAS, the City and FDOT desire to enter into the attached Third Addendum to the Airspace Agreement ("Third Addendum")which provides the City with the authorization necessary to make such improvements and also provides the specifications allowed within the Property; NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute the Third Addendum, in substantially the attached form, between the City and FDOT, allowing the City to install security cameras on a portion of the FDOT-owned Property identified as RWMS 1059 and RWMS 1060. The City Manager is further authorized {1}, subject to consultation with the Department, to negotiate and to execute any future amendments, extensions, or supplements to the form of the agreement,in a form acceptable to the City Attorney, and subject to budgetary approval at the time of need, with additional terms and conditions more particularly set forth in said Third .Addendum. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITYATTORNE'`" Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
