A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT,(S),
CLOSING, VACATING AND ABANDONING FOR USE A PORTION OF AN ALLEY
LOCATED ON THE NORTH SIDE OF NORTHWEST 7TH STREET, BETWEEN
34TH AND 35TH AVENUES, MIAMI, FLORIDA, LYING ADJACENT TO LOTS 3, 4, 5
AND 6, BLOCK 3, AMENDED PLAT OF DOUGLAS SEVENTH COMMERCIAL
CENTER, PLAT BOOK 25 AT PAGE 24, ALSO KNOWN AS 3435 NORTHWEST 7TH
STREET, MIAMI, FLORIDA, AS DESCRIBED IN EXHIBIT "A", ATTACHED AND
INCORPORATED.
WHEREAS, an alley located on the north side of Northwest 7st Street lying adjacent to the private
properties of Lots 3, 4, 5 and 6, Block 3, with an address of 3435 Northwest 7th Street, Miami, Florida,
is shown on the plat entitled "Amended Plat of Douglas Seventh Commercial Center" filed for the
record in Plat Book 25 at page 24 on March 31, 1926 ("Alley"); and
WHEREAS, there are no City of Miami ("City") plans, diagrams, drawings, records or similar
documents on file in the City's Public Works Department that indicate there was ever any maintenance
or construction of the alley by the City at any period in time; and
WHEREAS, there are no Public Works Department records or other documents indicating any
requirement or actual usage of the Alley as a public right of way at any time; and
WHEREAS, the warranty deed for the lots adjacent to the Alley include portions of the Alley in the
legal description; and
WHEREAS, the City has accepted ad valorem taxes for the Alley from the private property owner
adjacent to the Alley since 1979; and
WHEREAS, there is an absence of any City action or undertaking relative to claiming the Alley as a
viable Alley within the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The Alley, as described in Exhibit "A", attached and incorporated, is closed, vacated
and abandoned for use.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
