A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
ATTORNEY TO ENGAGE OUTSIDE COUNSEL, TRIAL & APPELLATE
RESOURCES, P.C., HAGENS BERMAN SOBOL SHAPIRO LLP, CENTER FOR
CONSTITUTIONAL LITIGATION, P.C., HARKE CLASBY & BUSHMAN LLP, AND
ERWIN CHEMERINSKY, ON A CONTINGENT FEE BASIS, ON TERMS TO BE
NEGOTIATED BY THE CITY ATTORNEY TO REPRESENT THE CITY IN LEGAL
ACTIONS AGAINST BANKING INSTITUTIONS REGARDING THEIR: (I) STEERING
INTO AND ISSUING DISCRIMINATORY MORTGAGES TO MINORITIES WITH
TERMS AND CONDITIONS THAT ARE SIGNIFICANTLY DIFFERENT FROM AND
LESS FAVORABLE THAN THOSE IN MORTGAGES ISSUED TO OTHER,
NON -MINORITY BORROWERS; AND (II) DENYING MORTGAGE CREDIT TO
MINORITIES ON THE SAME TERMS AND CONDITIONS AS NON -MINORITIES.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The City Attorney is authorized to engage outside counsel, Trial & Appellate
Resources, P.C., Hagens Berman Sobol Shapiro LLP, Center for Constitutional Litigation, P.C., Harke
Clasby & Bushman LLP, and Erwin Chemerinsky, on a contingent fee basis, on terms to be
negotiated by the City Attorney to represent the City in legal actions against banking institutions
regarding their: (i) steering into and issuing discriminatory mortgages to minorities with terms and
conditions that are significantly different from and less favorable than those in mortgages issued to
other, non -minority borrowers; and (ii) denying mortgage credit to minorities on the same terms and
conditions as non -minorities.
Section 2. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
