A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE RESPONSES RECEIVED OCTOBER 12, 2012, PURSUANT TO
INVITATION FOR QUOTATION NO. 340302, ISSUED IN ACCORDANCE WITH
SECTION 2.29 OF REQUEST FOR QUALIFICATIONS NO. 222246, AS
AUTHORIZED PURSUANT TO RESOLUTION NO. 10-0419, ADOPTED
SEPTEMBER 23, 2010, FROM LOAD IT AWAY, LLC., AND U.S.A. SCRAP METALS
& RECYCLING CORP., ("ADDITIONAL QUALIFIED PROPOSERS") AS IDENTIFIED
ON "EXHIBITA", ATTACHED AND INCORPORATED, TO PROVIDE COMMERCIAL
SOLID WASTE HAULING SERVICES WITHIN THE CITY OF MIAMI; AUTHORIZING
THE CITY MANAGER TO EXECUTE NON-EXCLUSIVE COMMERCIAL SOLID
WASTE FRANCHISE AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED
FORM(S), WITH THE ADDITIONAL QUALIFIED PROPOSERS FOR SAID
SERVICES, FOR AN INITIAL CONTRACT PERIOD OF FIVE (5) YEARS WITH
OPTIONS TO' RENEW FOR THREE (3) ADDITIONAL ONE (1) YEAR PERIODS.
WHEREAS, pursuant to Resolution No. 10-0419, adopted September 23, 2010, and pursuant to
Section 2.29 of Request for Qualifications ("RFQ") No. 222246, on September 14, 2012, the Miami
City Commission authorized the Purchasing Department to issue on-line Invitation for Quotation
("IFQ") No. 340302 in order to qualify additional proposers to provide Commercial Solid Waste Hauling
Services; and
WHEREAS, two (2) out of the three (3) proposers who responded to IFQ No. 340302 were
immediately deemed qualified and are therefore being recommended as additional qualified proposers
for the provision of Commercial Solid Waste Hauling Services; and
WHEREAS, as the qualifications of one (1) out of the three (3) proposers who responded to IFQ
No. 340302 are still be reviewed and upon completion, if deemed qualified, will then be recommended
for award as an additional qualified proposer for the provision of Commercial Solid Waste Hauling
Services;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The responses received October 12, 2012, pursuant to IFQ No. 340302, issued in
accordance with Section 2.29 of RFQ No. 222246, as authorized pursuant to Resolution No. 10-0419,
adopted September 23, 2010, from Load It Away, LLC., and U.S.A. Scrap Metals & Recycling Corp.,
("Additional Qualified Proposers"), as identified on Exhibit "A", attached and incorporated, to provide
Commercial Solid Waste Hauling Services within the City of Miami, are accepted.
Section 3. The City Manager is authorized{1} to execute Non -Exclusive Commercial Solid Waste

Franchise Agreements, in substantially the attached form(s), with the Additional Qualified Proposers
for said services, for an initial contract period of five (5) years with options to renew for three (3)
additional one (1) year periods.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City ChartE
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar c
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effec
immediately upon override of the veto by the City Commission.
