HomeMy WebLinkAboutAnalysis, Color Maps & PZAB ResoANALYSIS FOR ZONING CHANGE Virginia Key File ID 12-01180zc2 Article 7, Section 7.1.2.8.b.(2) of Ordinance 13114, the Zoning Ordinance of the City of Miami states that, the City may conduct a comprehensive review of the Miami 21 Atlas every two years to evaluate the development direction of the City's neighborhoods and determine if additional amendments are appropriate. The Planning and Zoning Department having conducted sad biennial review, has found the following changes to be appropriate and consistent with the development direction of the city's neighborhoods. AP ication requests: The request is to change the current zoning classification of the selected properties located approximately at the east side of Virginia Key from T1 'Natural Transect Zones" and CI "Civic Institution Zones to CS "Civic Space Zone'. The subject properties are located within the Downtown NET area, and consist of selected properties comprising of approximately 52.4± acres of land, as depicted in Exhibit "A" (A complete legal description is on file at the Hearing Boards Office) Review and analysis of the proposed changes finds that: • Virginia Key is located midway from mainland City of Miami and the Village of Key Biscayne and is defined by natural areas, parks, open space, and limited development. • The requested changes are for selected properties located approximately to the east and south sides of the Miami -Dade Water and Sewer Treatment Plant on Virginia Key, • The proposed changes consist of changing the zoning classification from T1 "Natural Transect Zones" and CI "`Civic Institution Zones" to CS "Civic Space Zone' within the selected subject properties. • The T1 Transect designation is intended for lands permanently set aside for conservation in a natural state. The subject properties within this designation are disturbed lands with fill and improvements related to its recreational use. • The subject properties with CI Transect designation are located to the south and northeast side of the existing Miami -Dade Water and Sewer Treatment Plant and are not within the property lines of this facility. • The subject changes comply with the Virginia Key Master Plan adopted by the City of Miami Commission on July 22, 2010. • This change will require an amendment to the Future Land Use Map of the Miami Comprehensive Neighborhood Plan for the subject areas from "Major Institutional, Public Facilities, Transportation, Utilities" and "Conservation" to "Public Parks and Recreation", Based an these findings, the Planning and Zoning Department is recommending approval of the application as presented. LI a) The proposed change conforms with the adopted Miami Comprehensive Neighborhood Plan and does not require a plan amendment. ® ❑ ❑ b) The proposed change is in harmony with the established land use pattern. ❑ ❑ c) The proposed change is related to adjacent and nearby districts. ❑ ❑ d) The change suggested is not out of scale with the needs of the neighborhood or the city. ❑ ❑ e) The proposed change maintains the same or similar population density pattern and thereby does not increase or overtax the load on public facilities such as schools, utilities, streets, etc. ❑ li ❑ f) Existing district boundaries are illogically drawn in relation to existing conditions on the property proposed for change. l�f CI ❑ ❑ g) Changed or changing conditions make the passage of the proposed change necessary. ❑ ❑ h) The proposed change positively influences living conditions in the neighborhood. ❑ i) The proposed change has the same or similar impact on traffic and does not affect public safety to a greater extent than the existing classification. ❑ ❑ j) The proposed change has the same or similar impact on drainage as the existing classification. ❑ ❑ k) The proposed change has the same or similar impact on light and air to adjacent areas as the existing classification. E ❑ ❑ I) The proposed change has the same or similar impact on property values in the adjacent area as the existing classification. y ❑ ❑ m) The proposed change will contribute to the improvement or development of adjacent property in accord with existing regulations. LI ❑ n) The proposed change conveys the same treatment to the individual owner as to owners within the same classification and the immediate area and furthers the protection of the public welfare. ❑ o) There are substantial reasons why the use of the property is unfairly limited under existing zoning. ❑ p) It is difficult to find other adequate sites in the surrounding area for the proposed use in districts already permitting such use. Gibson offered the following resolution and moved its adoption: A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD RECOMMENDING APPROVAL TO THE MIAMI CITY COMMISSION, AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114. BY CHANGING THE ZONING CLASSIFICATION FROM "Cl'' CIVIC INSTITUTION ZONE AND "T1" NATURAL ZONE TO "CS" CIVIC SPACE ZONE, FOR SELECTED PROPERTIES LOCATED AT APPROXIMATELY THE EAST SIDE OF VIRGINIA KEY. MIAMI, FLORIDA; AS DEPICTED IN ATTACHED "EXHIBIT A"; FURTHER, THE PLANNING AND ZONING DEPARTMENT HAVING CONDUCTED A BIENNIAL EVALUATION OF THE MIAMI 21 ATLAS, PURSUANT TO SECTION 7.1.2.8.B.2, HAS FOUND THE CHANGE TO BE APPROPRIATE AND CONSISTENT WITH THE DEVELOPMENT DIRECTION OF THE CITY OF MIAMI'S NEIGHBORHOODS, THE RESULTING ZONING CHANGE APPROVED THROUGH THIS BIENNIAL EVALUATION OF THE MIAMI 21 ATLAS, PURSUANT TO SECTION 7.1.2.8.B,2, SHALL NOT PROHIBIT. PREVENT OR LIMIT OWNERS OF AFFECTED PROPERTIES IDENTIFIED HEREIN FROM APPLYING FOR A REZONING PURSUANT TO SECTION 7.1.2.8.G.5; FURTHER DIRECTING THE PLANNING AND ZONING DEPARTMENT TO REVERT ANY ACCOMPANYING FUTURE LAND USE CHANGE ADOPTED FOR ANY ZONING CHANGE NOT APPROVED IN THIS ORDINANCE IN ORDER TO MAINTAIN CONSISTENCY BETWEEN THE ZONING ATLAS OF ORDINANCE NO. 13114 AND THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN, FUTURE LAND USE MAP; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
