AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 35/ARTICLE
IV OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "MOTOR
VEHICLES AND TRAFFIC/PARKING RATES," MORE PARTICULARLY BY AMENDING
SECTIONS 35-191 THROUGH 35-196 TO UPDATE RATES AND FACILITIES; CONTAINING
A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami ("City") is authorized to set the rates for parking fees
throughout the City; and
WHEREAS, the rates have not been updated or revised to reflect average market rates
or the inclusion of additional facilities throughout the City since 2009; and
WHEREAS, the City Commission authorizes the increase of various fees and the
inclusion of additional facilities, as set forth in the Code of the City of Miami, Florida ("City
Code"), as amended, and more particularly described below;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted and incorporated as fully set forth in this Section.
Section 2. Chapter 35/Article IV of the City Code is amended in the following
particulars:{1}

MOTOR VEHICLES AND TRAFFIC
ARTICLE IV PARKING RATES
Sec. 35-191. On -street parking meters and monthly on -street permit program.
On -street parking meters:
(a) The maximum hourly rate of charge, and fees for parking in metered spaces in on -street
parking meter zones, and on -street monthly permit zones, except as otherwise provided herein,
are as follows:

(b) Monthly on -street permit program: The monthly on -street permit program is available, in
certain areas of the city, pursuant to this chapter, on a first -come, first -serve space available
basis. Permits are to be issued by the department of off-street parking. The chief executive
officer ("director") is expressly authorized to implement this program and shall oversee and
develop these special on -street parking permit areas as they are deemed necessary by the
director where the director determines that sufficient off-street parking facilities are not available
in an area to accommodate monthly parking demand. Such areas will be subject to all
applicable laws, resolutions, rules and guidelines governing their operation established by the
city commission and/or board/department of off-street parking.

At no time shall such parking permits be sold for a period longer than 12 months, unless a

(c) City of Miami employees who reside within the city will be able to receive a 20 percent
discount towards the purchase of one monthly permit (one permit), as long as they remain
eligible. Each additional permit will be sold at regular price.
(d) On -street parking meters and monthly permit rates may be increased by resolution of the off-
street parking board to a maximum of three percent (3%) annually in any individual fiscal year,
or at an accrued annual rate of three percent (3%). The increase shall not exceed an accrued
annual rate of three percent.
Sec. 35-192. Municipal parking garages.
(a) The maximum rates and fees charged for parking in off-street municipal garages are as
follows (all rates exclude parking surcharge and all applicable sales tax):

Rates not applicable during "MLB Events", "Other Events" or "Stadium Events" as defined by,
and subject to any additional provisions of, the City Parking Agreement entered into on or about
April 15, 2009, by and among the City of Miami, Miami -Dade County and Marlins Stadium
Operator, LLC.
(b) These parking garage rates may be increased by resolution of the Off-street Parking Board
to a maximum of three percent (3%) annually in any individually fiscal year, or at an accrued
annual rate of three percent (3%). The increase shall not exceed an accrued annual rate of
three percent (3%).
(c) The following fees will be assessed during special events, film production and construction
uses for off-street parking garage rental within the above garages:
(i) $20.00 administrative fee assessed for any meter rental of five meters or less.
(ii) $25.00 administrative fee assessed for any meter rental of six to ten meters.
(iii) $30.00 administrative fee assessed for any meter rental of 11 meters or more.
(d) The rate of charge $10.00 per off-street parking garage, per day, plus sales tax, if applicable
will be assessed during special events, film production and construction uses for within the
above garages.

These rates may be increased by resolution of the off-street parking board to a maximum of

a. $20.00 administrative fee assessed for any meter rental of five (5) meters or less.
b. $25.00 administrative fee assessed for any meter rental of six (6) to ten (10) meters.
c. $30.00 administrative fee assessed for any meter rental of eleven (11) meters or more.
(e) The rate of charge $10 per off-street parking garage, per day, plus sales tax, if applicable will
be assessed during special events, film production and construction uses for within the above
garages.
Sec. 35-194. Metered space rentals; bagged meter fees; on street non -metered space
rental.
(a) The rates and fees charged for metered space rentals, bagged meters and on street non -
metered space rental are as follows (all rates exclude parking surcharge and all applicable sales
tax):
(1) Administrative processing fees: The administrative fees for the processing of all metered
parking space rental permits are set forth herein and may be amended from time to time, by the
city commission. The administrative fee is in addition to any fee paid for parking stalls, meter
bags, or linear curb space.
The administrative fee structure is as follows:
a. $20.00 administrative fee assessed for any meter rental of five (5) meters or less.
b. $25.00 administrative fee assessed for any meter rental of six (6) to ten (10) meters.
c. $30.00 administrative fee assessed for any meter rental of eleven (11) meters or more.

f(3)-Metered parking space rental fee. The rate is $10.00 per meter, or for every 20 linear feet,
per day. The fees are set forth herein and may be amended from time to time by the city
commission.
-( -Bagged meters for production and film use. The department of off-street parking may
provide bagged meters on an as -needed basis within the sole discretion of department of off-
street parking, taking into account the parking needs of the city, bagged meters to
accommodate production, staff, and film needs. A copy of a valid, city issued production/film
permit must accompany each application for bagged meter rental. The fee per space is $10.00

per meter, or for every 20 linear feet per day, payable 24 hours in advance. Only essential
vehicles shall be allowed to park at bagged meters. Crew parking can be arranged with the
department of off-street parking. Meter bags for production and film use shall be red in color and
shall state, "No Parking/Tow Away", and shall be strictly enforced. The fee per meter, or for
every 20 linear feet, is $10.00 per day, payable 24 hours in advance. The fees are set forth
herein and may be amended from time to time by the city commission.
{(5)-Bagged meters and parking space rentals for special events/construction. The
department of off-street parking may provide on an as -needed basis, at the sole discretion of
department of off-street parking, taking into account the parking needs of the city, bagged
meters and parking space rental to accommodate special events, construction, and staff. A copy
of a valid, city issued special event permit and/or building permit, as applicable, must
accompany each application for a bagged meter rental. The fee per space is $10.00 per meter,
per day, payable 2•1 hours in advance. Only essential vehicles used for the special event and/or
construction shall be allowed to park at bagged meters. Parking spaces for special event or
construction staff, can be arranged with the department of off-street parking. Meter bags for
special events and construction shall be red in color and shall state, "No Parking/Tow Away".
Meter bags may only be issued by the department of off-street parking, and shall be strictly
enforced. The current rate is $10.00 per meter, or for every 20 linear feet, per day, payable 24
hours in advance. The fees are set forth herein and may be amended from time to time, by the

jJ(Valet metered space rental and on -street non -metered space rental. Those companies
with a valid parking service permit issued by DOSP shall pay the following fee for metered and
non -metered space used for the ramping of valet services:

There is a non-refundable, one time application fee of $150.00 per valet location before DOSP
may approve the initial permit. After DOSP approves the initial application, the fee for the six-
month permit is $500.00.

Sec. 35-195. Meter removal.
(a) Temporary parking meter removal. The department of off-street parking may provide for the
temporary removal of parking meters to accommodate construction and other limited needs.
The fee for the removal of the meter and post shall be $50.00 per meter. The cost for re-
installation of the meter and pole shall be $50.00 per meter. Meter removal and replacement
shall be paid to the department of off-street parking in advance at a rate of $100.00 per meter.
The fee to remove a Pay and Display Machine is $250.00 and the fee to install a Pay and
Display Machine is $250.00. Additionally, the applicable bagged meter rental rate shall be
assessed on a per space, per day basis, payable in advance, until such time as the parking
meter is re -installed. No such removal shall last for a cumulative period of more than 90 days
during any calendar year.
(b) Permanent parking meter removal. Permanent parking meter removal or loading zone
removal requests are strongly discouraged and are granted in withi ► at the sole discretion of
DOSP'S off street parking board Chief Executive Officer, consistent with the parking needs of
the Csity. The fee for the permanent removal of a metered parking space shall be as follows. or
The minimum
period for removal of a meter or loading zone parking space (20' of Curb -line) will be ten years.
The fee for the removal of a parking space is to be paid in advance in a single lump sum fee.
The fee shall be the average annual system -wide revenue generated by a single metered
parking space, or the highest annual revenue generated by a single metered parking space in
the area where removal is requested, whichever fee is greater. This fee shall be calculated by
street or meter zone, based upon the most accurate revenue data available and maintained by
DOSP.
If applicant anticipates the creation of additional, new or replacement parking spaces or loading
zones, it shall provide DOSP with any and all information regarding the number and location of
these spaces or loading zones. Once the applicant has completed the project, it may request
from DOSP a refund for the specific number of spaces or curbline not permanently removed
from the public parking inventory.
(c) Parking Infrastructure Reserve Fund (PIRF): When a request for the removal of a parking
space is made, as defined above, all fees collected in accordance with the process shall be held
in a Parking Infrastructure Reserve Fund. DOSP shall use the monies in the PIRF for the
acquisition and installation of automated parking meters, automation of existing facilities,
expansion of the centralized operation capabilities, future development projects, land acquisition
and other improvements to the public parking system.
Sec. 35-196. - Restricted residential parking program.
(a) The city commission hereby establishes the following restrictedresidential parking (RRP)
zones. These zones are created to protect the quality of life of the city's residents in areas
where residential parking is severely impacted by competing uses. The executive director of the
department of off street parking DOSP'S Chief Executive Officer shall have the authority to
create rules, regulations, and guidelines in conformity with this section for the parking of
vehicles and the issuance of resident, visitor, or temporary, permits within the RPP RRP zones.
The RPP RRP zones are hereby established as follows:

(b) Resident parking permits. A restricted, residential zone resident must purchase restricted
residential permits from the department of off-street parking. Residents can purchase up to
three (3) parking permits per household. Parking spaces within the RRP zones are not
guaranteed and are restricted to a specific RRP zone. The fee for these zones will be as
follows:
(1) $25.00 per year for first vehicle.
(2) $50.00 per year for two vehicles.
(3) $75.00 per year for three vehicles.
(c) Temporary residential guest parking placard/hang tag permits. Temporary residential guest
placard/hang tag permits, authorizing guest parking in the restricted residential zones are
available from the department of off-street parking. Such permits are to be issued for a bona
fide guest of a resident of the restricted residential parking zones at a fee of $1.00 per day, for a
maximum two -week period during any calendar year. A restricted residential zone resident must
purchase residential guest parking placard/hang tag permits. Temporary guest placard/hang tag
permits are only valid within the restricted residential zone of the resident purchasing the guest
permit, and are not valid at any parking meter, municipal parking lot, garage, or other restricted
residential parking ("RRP") zone.
(d) Creation of Additional RRP Zones. DOSP shall review each request for a new RRP zone. If
DOSP'S Chief Executive Officer approves, DOSP shall create a new RRP zone. DOSP will
create new RRP zones twice a year, in April and October. RRP zones apply to single-family
homes, duplexes, condominiums and apartment complexes with ten or fewer units, which
contain habitable rooms for non -transient occupancy. Hotels, suite hotels, motels, apartment
complexes with eleven or more units, boardinghouses and daycare centers shall not be
considered for a RRP zone."

Section 3. If any section, part of section, paragraph, clause, phrase of work of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof.{2}
